excel parking a-u-l

Hi my wife has had a pcn through the post from excel parking after she parked in Ashton under lyne she did not relise it was pay and display and thought it was free parking because she was shopping at a couple of the shops there . Ive had a good read through the newbie section and a few posts and just want to make sure i am doing the right thing .Am i right now to send them a copy of the template of the appeal letter from the forum and wait for their response ?

Ive also read i should ignore it because they are a member of the ipc any input would be great im just a bit confused thanks gav

    no need to be confused

    you send the template letter to them and appeal the postal pcn

    then if they dont cancel, ignore for 6 years unless they try court proceedings (ignoring any and all debt collector letters)

    Redx does not favour appealing to the IAS, he thinks that it is a waste of time, but I disagree.

    A refusal in their kangaroo court pulls the rug from under the PPC, who will realise that if the anonymous refusal is shown to a judge he/she will find against them, Read this

    I also favour appealing IPC PCNs as it costs the PPC money. The IPC rejection letter would be also a very useful piece of evidence in favour of the motorist in the unlikely event that it ever made it to court in my humble opinion.

    To be clear - appeals to the IAS are, in themselves, going to be rejected almost unilaterally. So if you are looking for a win there, then it is a waste of time.

    However, by going through the process of following all appeals available before the matter arrives at a court, you would be able to show that you took all reasonable steps to have your case heard by an appeal service.

    Furthermore, should a court see the wording of a typical IAS rejection, this would stand you in good stead, particularly when the link between the IPC, IAS and Gladstones is added.

    The decision you have to make is this. If you are convinced 100% that the ticket would never get to court, that you are prepared to deal with no-hope but persistent bailiffs, then you will save yourself the cost of a stamp and 10 minutes time by ignoring the IAS appeal service.

    But if you think that there is even the remotest chance of it getting to court, then by having gone through all the pre-court hoops, you will be much less likely to brass off the judge for wasting his time on a trivial matter that could have been dealt with by ADR (in his opinion) whilst showing him just how biased an IAS appeal is which may hep the next motorist he has to deal with as well.

    and do not forget to go back (or tell the wife to) the shops visited an complain ..... even take what was bought back for a refund as now they are to expensive ;)

    this or complaining to the land owner is one of the few ways to sort this out now.

    depends where it was in A-U-L, if it was the one outside Gala Bingo near the bus station, then its Gala Bingo that own the land and parking is free for the first hour (although the signs say 30 minutes) - then its pay and display if the stay is longer

    Hi just an update on this i have now received papers from the county court business centre in northamptom via bw legal . I have just ignored the debt letters they sent they are now asking for £235 . I didnt appeal to the isa because i didnt think it would go this far now my wife is stressing now cos its in her name and she thinks going all the way to northampton is a waste of time and money and we might as well just pay it . Ive had a look through the newbie guide again and if i want to defend it would i have to type my own defence letter stating the pinot why i think it is wrong . any help or thoughts would be great Gav

  • Hi I have just received exactly the same thing this morning for the same car park. Interesting though that someone says its really 1 hour free not the half hour that they say on their sign?
    I am unsure what to do. I was thinking of just paying them the initial 60 plus a little more for admin and the costs of sending me about a dozen letters from various companies, some of their companies at one point were even saying I displayed an invalid ticket which is simply not true. I don't think they will go for it though and then I have entered into correspondence with them. Its obvious excel sell the debt off to another company. Up to now the business court centre is the 4th not counting excel. Have you noticed though that none of the letters are actually ever signed by a real person, they seem very unprofessional to me.
    I keep getting told though that it is only Excel that can take me to court but surely they can have someone acting on their behalf like BW Legal? How much over did your wife stay after the initial 1/2 hour free if you don't mind me asking?
