2xAPCOA Fines in 2 Weeks - Advice
Options

Hi, my car has got 2x APCOA parking fines within a 2 week period. I have read through the newbies thread and produced an appeal letter to APCOA initially for the first of the two PCN.s but I am just wondering whether I should reference both PCN's on the letter to save doing a second one?
Will this effect a follow on appeal to POPLA, i.e. would I be able to appeal against both PCN's together, or would they have to be separate (the PCN is issued for the same reason of No Valid Payment in both cases).
Thanks

the normal advice is to do do separate appeals , you have not given much detail about your dastardly deeds ..... so it is hard to say if they may be linked up at POPLA stage .... unless you have good reason then use the template in the newbies thread as is ...... for your first appeal.....
Oh and if you have read the newbies thread why are you still using the 'F' word ??????
they are speculative invoices

Appeal them separately, you can use identical wording and just change the reference number.
If you make 2 POPLA appeals, it costs them twice as much
But wait until you get the NtK in the post. If you fancy, you can also check with the DVLA that they paid for your details twice, too...0 -
Thanks, I will do them separately then.
As per the details resulting in the Speculative Invoices (sorry Ralph-y)....
The car is regularly parked (most weekdays) across two different APCOA controlled train stations, but the station usually changes on alternate days, so only 1 day at a time can be paid for, which means quite a rigmarole each time which requires going through the whole automated phone system to change the location.
There has been a few PCN's over the years, most have been paid, though one was appealed to them directly a while back citing mitigating circumstances (which I now realise is a waste of time).
The PCN's have all been due to genuine forgetfulness of the driver to make the payment on given days.
I just feel the amount of the parking fines is so disproportional to the offence, there would be little problem paying the actual parking fee retrospectively even with a small amount added on for administration (I'm talking a £ or two).
Furthermore, as a the keep of the vehicle which earns them close to 1K a year in parking fees, you would like to feel that from a customer service point of view there was some reasonable leeway for non-malicious non-payment for a car that is normally paid for most working days of the year!0 -

Well, that didn't last long! :rotfl:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Further query, regards the appeal, and from the template, should I include the line:
Your 'Notice' fails to comply with the POFA so there can be no keeper liability.
From what I can tell on the notice it seems quite thorough? Or does it not really matter at this stage as the object is to get to the POPLA stage?0 -
thorough doesnt mean it complies with their trade body rules
leave it in, the point here is not to be arguing with them at this stage, its:-
CANCEL , or issue a POPLA code for each pcn (INVOICE)
send in 2 appeals, even if they are in the same envelope, with a free certificate of posting from the P.O. (not recorded)
dont just stick a stamp on and post in a postbox, prove you sent them with a free receipt from the P.O.
of course its disproportionate ! that is why Barry Beavis was in the Supreme Court in london last thursday (3 times he has been to court, because he thinks his pcn was disproportionate)0 -
Thanks Red x
Is there really much benefit in waiting for around the 20 days?
The first is from nearly two weeks ago, the 2nd only a few days?
They say that if the challenge is received in the 14 day "discount" period this will be offered again if the claim is rejected (but not sure if that applies to an on-going claim to POPLA) - is there some worth of sending the initial challenge within this period?0 -
the point is explained in the NEWBIES sticky thread
if these are windscreen tickets, then the DRIVER has that time window to pay, but the advice is never name the driver
in which case the RK appeals after day 21 (we used to say day 25 so it gets there around day 28 but people used to forget or do something different) , the PPC is supposed to then send an NTK out between day 29 and day 56 if they are abiding by POFA - to the RK (who has already appealed to try and stop debt collectors getting involved)
its not clear from your posts if these are windscreen tickets or NTK,s , as you appear to think that they are both (which they cannot be)
are you sure you have read and digested that newbies thread ?
you asked about the line that says the NTK isnt compliant, yet I dont think you have had any NTK`s !!
do you know what the differences between driver and keeper are ? and the notices they may get ?
it is the KEEPER that is appealing (read the template appeal letter) , not the DRIVER0 -
Yeah, I generally got the bit about the driver and keeper (I think!) but maybe fully not grasped the different notices... (I have read through the newbies thread a few times, but it's still a lot to take in when you come at this for the first time!)
I sure read the bit about the 20days, and the query was is there actual experience of it being detrimental in practice to do so prior, or experience of it being an actual benefit of waiting...
They are windscreen tickets.
I was assuming the reference to the "Notice" in the template is the PCN not an NTK, as there is unlikely to be an NTK prior to the initial challenge, have I got this wrong?0
