    Theres been some developments now and i need some more advice.

    My lease expires on saturday coming. I have decided that i just want to move out back to my mums after Saturday.

    Do i need to give the landlord any notice? I told her i want to give her the keys back on Friday night but she told me i have to give her 40 days notice. Is this correct or can i just hand back the keys on Friday?

    40 days notice is part of the AT process, so does your LL now say you do have an AT, despite issuing you with an (invalid) AST? In theory she may well be right, but given the mess she has made of the whole thing you may be able to negotiate your way out of it. I would even more recommend that you speak to Shelter Scotland now so that you are armed with the full facts of what you can do in this situation.
