    If this is for form ID1, photo ID is not required. See section 3B here;

I did find that, don't understand it all. Solicitor says they have to have a photo id for the first part and 3 other docs for the second part . especially as she is in hospital and will then be in a home... and they need to do other stuff I think so they know what she is signing when signing to sell her house... she is not lala, or in the land of nod... another solictor from the same company recently came to the hospital to see and witness her sign her will.... so we don't understand it..... he's seen her and knows she has all her brains intact..

I'm sure your solicitor can read and understand the meaning of "OR". So that means they must want the ID so satisfy their own requirements, which I can understand. But there is no need for them to mislead you with the suggestion that this is required by the land registry.

If it's a firm of solicitors, you might consider contacting a senior partner.

    Hi kinger

that is a good point. I will tell hubby to ask why they need a photo for the ....

So I know that you must verify who you are ( because of fraud) estate agent/ solicitor..... so is there a set process/procedure or a standard policy for this??

As kinger101 suggests such requirements can often be set by the solicitor acting

From purely a registration perspective IF the application is lodged by a solicitor/conveyancer then they do not submit the form ID1 (if they have asked for one) as the application form AP1 allows them to state that they have satisfied themselves as to the parties identities etc and they then include the details fo who has acted for those parties for example.

Form ID1 does require a recent photograph to be included/attached and does ask for photo id evidence where available but as posted also has an OR option re the latter.

Some solicitors will use form ID1 to satisfy their own requirements but confirming someone's identity before you act for them in this way has long been good practice and/or a requirement on the part of solicitors and pre-dates the introduction of our own identity requirements.

I'm in the same situation. The EA says I must produce photo ID. I don't have a valid passport or driving licence.

I will renew my passport once I find my marriage cert, but some people don't drive and don't have a passport through choice so I don't see how photo ID can be mandatory.

thanks to all of you and your helpful repies.
Meant to come back sooner but well, ******** happens

the question no longer applies as person in question passed away..

but it is a huge problem when photo id is not available... and quite frankly i feel offended that my documents whould not be sufficient... having english birth cert etc.... but not only that the fact that the government except me with no picture when taking money off me . I think I would be asking the solicitor for photo id also as proof of employment to do a job for me. mmmm your views

Lenders and solicitors have lists of acceptable items which include those without a photograph.

Often, they will require two items for ID and two items for proof of address, but as stated there is no law which insists on photographic items being essential/mandatory.

Last time we had such a case we accepted;-

    HMRC tax code notice
    medical card
    recent bank statement
    council tax bill.

We are required to assist the authorities in investigating a potential future allegation of money laundering. That is the purpose of the checks, to add to the audit trail. Nothing more, nothing less.
