Jet2 flight delay before 2009

I recently claimed for a flight delay which was in 2008.
I am aware that flights before 2009 are difficult to claim for and have been rejected for my claim. This website states that EU laws allow you to claim back to 2005, however taking them to court will only allow me to claim back 6 years.
I am confused and unsure how to respond to this?

    You can't do anything - you are out of time. (The MSE website is misleading.)

    EU law covers the whole of the EU, each country will have it's own regulations for court cases. Scotland is 5 years, England and Wales is 6 years (there may be countries where it is longer or shorter)
    When a claim is rejected the next/last step is court. You are too late for that in the UK so just need to forget about it as there is absolutely nothing you can do (you needed to have logged your claim with the court before the 6 year anniversary of the flight)

    this website has confused me with it saying I could go back to 2005.

    NO! sorry You can't claim.

    It makes it worse being Jet2, so as others have said you have zero chance of success IMHO.

    EU261 dating back to 2005 is correct. The issue is when the airline rejects the claim, the time you have to take them to court varies by country.
    The airlines know that there is nothing you can do if you are time limited...many play slow tennis with mail to stretch the time out until you have run out of time
    I have not seen any case of an airline paying out after the 6 year date...why would they? Look at the Jet2 thread and see the number of people that have valid claims within the last 6 years that have not been paid and are having to go to court and decide whether you think Jet2 will pay you when they have no need to.
    I personally would put a safe bet on to say I will match what you get from Jet2 :j

    I know of one case Caz, that was paid beyond six years, I'd search for it, but it's like looking for the proverbial needle in a haystack from what I recall of the post, it didn't go through court and was paid as a gesture of goodwill.

  • Thankyou very much for your reply, I have nothing to lose to keep trying but am just unsure of how to carry on from now, maybe a very polite approach might make them do another gesture of goodwill?

    well I, and many others, are still being strung along for valid claims from 2010...I put it to a NWNF in 2013 and am still waiting to see if it needs to go to court. I would not bank on any goodwill from Jet2 since they have been the main airline that has been fighting having to pay valid claims for the last few years
