    What did TS say, when you complained?

    What did the BPA say when you complained a PPC was operating on land on which they have no authority and issuing wrong POPLA codes?

    Trading Standards unfortunately weren't interested as it wasn't a major enough issue and they only deal with major stuff in my area apparently!

    BPA I haven't approached yet as I wanted to go through the appeals process first.

    Well a month since my last post and STILL nothing. My appeal should've been heard around 14th September and I have chased popla every single week for an outcome. This entire process just seems ridiculous it really does. I'm forever emailing them for updates and I've had one response about 3 weeks ago saying my appeal hadn't been heard yet. IMO this is a really, really poor way to conduct an appeals process. Further email to be sent today...

    And just to rub salt in the wound, I saw a neighbour park almost exactly where I was parked on the day I got the ticket earlier today while the parking attendant was there and he just drove off!! So clearly he didn't see an issue with it this time! Luckily I got a picture of PTL's van and my neighbour's car in the same shot and forwarded this on to popla as hopefully further evidence.

    Because you have the right to park there, that is the beginning and the end of it, you write and tell them of your rights the once and that is the end of it.

    By chasing them every week, you are legitimising their power over your rights. Don't do this. Yes, it may go to court, but with your proof of the right to park, the court has to rule in your favour. And with a copy of your one letter telling the parking outfit that you have the right to park there, the court will know that the parking outfit is wasting their time.

    You can't be chasing old POPLA every week as they don't exist any more under that service provider and all emails bounce. You need to read that thread and wait, as long as you do actually have a POPLA appeal lodged under the old system and didn't just email POPLA.

    You could email the BPA to complain about this because your case is clearly not about the same issues as Beavis, so should have been decided ages ago.
    I suppose I might appeal to POPLA, but it would be a one statement of my rights to park on the land rather than an appeal

    Did you really appeal to POPLA just with a single appeal point? Brave but an admirable stand under the circumstances (by the way, PTL don't actually own any of it).

    Thanks for your advice, I was unaware there were issues with popla and the bpa. I'll wait to hear from them.

    There is only one relevant point to my appeal ie. They had no right to issue a ticket on that land. I think that's sufficient.

    Did you prove it with evidence of ownership? Hope so.

    If so, I think your case must be in the 'work in progress' (WIP) pile rather than the adjourned pile and you will get your case considered in any case. The BPA told me there are of course some fairly recent POPLA cases supposed to have been heard in September but were not, which are considered to be 'WIP'. Not adjourned for Beavis. Yours can't be adjourned for Beavis because your appeal point was so different.

    Be patient - I understand we'll hear more about these cases (WIP and adjourned) in a couple of weeks.

    Thanks, I wouldn't have ever known popla were having issues with bpa had I not posted on here, it's good to know there's a reason for the delays.

    Just to update, I've not heard a peep from popla. I know the ruling for Beavis happened some time ago, does anyone know whether popla are working through their backlog in light of this? Equally I've heard nothing from the actual parking company itself. It's almost tempting to believe they've decided to let it go lol.

    If you have legal title to the space, you can pop along to see a lawyer and ask them to write to PTL informing them they are trespassing if they enter your land - and any implied right is withdrawn.

    Also inform them that if need be you will seek a court injunction to prevent access and will sue for the costs of acquiring the injunction.

    If you have property rights, you should demonstrate you intend to protect these rather than use POPLA which is inappropriate in your case. Land ownership/possession is an absolute not something that can be debated.

    Do PTL actually "own" the other piece or are the just working on behalf of neighbouring owners
