Letting Agent contractor payment issue

    The letting agent has emailed me a copy of the court judgement. It shows the Claimant (the contractor) and Defendant (Lettings Agency) were in the county court early in June. It states that "IT IS ORDERED THAT 1. The Claimants claim is dismissed and 2. The Claimant pay the sum of £5.00 to the defendant"
    So it would appear this is not a court order forcing the LA to release landlords details?
    The LA have also strangely emailed me a list of all of the outstanding debt that this contractor are chasing from them, there are numerous properties and over £5,000 in total for work carried out in 2012 -2013. Surely their issue then is with the LA??! Or is it usual in this situation for the solicitor to pressure the LA for contact details for each individual landlord and pursue them for money? I just find the whole situation bizarre.

    How do we know what it is if you do not quote the claim?
    What you quoted shows that the contractor lost.

    Threads about a complex situations where the OP discloses information bit by bit are often a waste of time to all involved.
    Proper legal advice is sometimes necessary...

    Sorry for confusion. The letter they sent me is entitled "General Form of Judgement or Order". It has a county court stamp, date and claim number. It lists the name of the contractor as claimant and name of LA as defendant. It then simply states the name of the judge and address of the court and reads "Upon hearing representatives for the claimant and solicitor for the defendant it is ordered that..." then as I have explained in above post.

    Right, so there is no order for release of information. Contact the ICO https://ico.org.uk

    Otherwise, email the solicitor as above.

    You should focus on the issue at hands:

    Is the claim genuine?

    If it is, just pay up an move on.
    And do check that the agent did not already charge you at the time.

    I agree that the contractor should be paid if they have carried out the work.

    I just find it strange that a solicitors firm which would charge per letter (or per email in this case) would be used by the contractor if there are (estimating a bit) 40 Landlords.

    Each email could easily be £30, that's 25% of the claim!

    Why would the contractor not do this himself? - And this 'court order' nonsense.

    £5 costs? - even half a day loss of earnings would be upto £45. Why would the LA claim £5?!

    What was the claim on the order? Small claims track? for what amount

    It all smells fishy to me.

    Thanks jjlandlord - this is what I'm trying to check. Just surprised the first I heard about it is an email from a solicitor demanding payment for something owed (by my letting agent) from 2012. Also concerned that the letting agent have just given my (and others) contact details freely to a solicitor rather than deal with the problem themselves.

    Contact the ICO.

    As for the solicitors, throw down the initials of the firm. I suspect i can guess it begins with a G ends in ES.

    The agent could legally disclose your details if it was clear that they were requested in relation to legal proceedings.
    Do not waste time with this red herring.
