I recently started a thread in relation to a NTK i received from PCS

I hope someone can help, someone i know has been visiting a friend on a private estate and has been given a few windscreen tickets over the past couple of months, they were under the impression to just simply ignore- and they are not sure if this is the right thing to do- They have just got a NTK through the post from PCS (Parking Collection Services) on behalf of Secure A Space and they are sure that there are a couple more on the way so they were wondering if someone can advise them with what the best course of action to take- if any.

I received the following advise, which i followed:
Dear PCS,
I am appealing as keeper. The notice to keeper is not compliant with POFA 2012 and therefore as keeper I am not liable. Additionally the charge is higher than that sanctioned by the BPA, and as per the guidelines laid out in ParkingEye v Beavis, not justifiable as it is significantly larger than council charges.

They then reject that and give you a POPLA code.

You then bang in a fuller appeal to POPLA. Don't be tempted to add to the appeal. Do go and revisit your post and edit it if any clue to the driver is present. Otherwise, they could pursue that person.







I have now received the following;

Thank you for your email regarding the above Parking Charge Notice (PCN).

What you need to do now

So I can contact the driver for payment of the amount due, please let me know their name and address. Please let me have these details by 31st July 2015.

What if you do not know who the driver of the vehicle was

As you are the registered keeper of the vehicle, I am assuming that it was being driven with your consent and that you will therefore know who the driver was.

If you do not provide details of the driver by the date shown above, we will continue to contact you for payment of the parking charge on the assumption that as the registered keeper you were also the driver of the vehicle (as established in Elliott v Loake [1982]).

Payment of the £120.00 outstanding can be made online or by phone.


What will happen if you do not name the driver of the vehicle or make payment

If you do not name the driver or the amount outstanding is not paid by the date shown above, it will be recommended to our client that court action be taken by them to recover the amount outstanding.

More information

· Under the Pre-Action Protocol of the Civil Procedural Rules, court action must only be viewed as a last resort. By requesting the driver’s details we are attempting to avoid this outcome.

    Why did you start as new thread at all? Please PM Crabman (forum guide) to ask for the threads to be merged. Starting multiple threads for the same case annoys people intensely and will not get you the help you want.
