Travel Insurance Claim not paid

Hi all, looking for some advice really as this is really playing on my mind.

I had a ski accident earlier this year, put my claim in (Travel Claims Facilities) with all the evidence/forms etc. The hospital bills and helicopter came to E3000 ish. TCF accepted the claim and requested my excess (£150) which I paid.

They have still not paid the hospital bill.....I have rang every few days for over a month and I get the same story - my file was passed to the wrong department, they can't find my file, someone will look into it etc.

The hospital bill debt has now been passed to an Austrian solicitor/debt collection company and they are threatening me with legal action and are now adding their charges to the claim.

I have raised a formal complaint with TCF but have had no response so far, I really don't know what to do!? I could pay the claim (and now the additional E500 worth of charges to get the debt collection off my back) but if TCF have accepted the claim and taken my excess are they now liable for the bill? Can I be taken to court over this?

Grateful for some advice or ideas!

  • Forward copies of all the legal threats and invoices to the insurance company. You could write back with the insurance company's details, but it's really their problem now.

    Absolutely - make it clear too that you expect compensation from them for the trouble and upset they have caused you.

    "Trouble and upset" is a term used by FOS. Remember, too, that they have 8 weeks from receipt of your complaint to respond to it.

    Make all communication in writing and keep copies. If you e-mail it then keep copies of the e-mails. If you snail mail it get proof of posting (free from the Post Office).
