moneyistooshorttomention - Yes you are correct. I will be having the discussion with him about a potential sale to myself as this would be fantastic and an ideal scenario and way to significantly increase my house value as Jennifer says. Im not a nasty person and would always seek an amicable solution that suits both.
I would not pressure a sale and if he had no intention to move or is thinking of doing so maybe in 10 years. I cannot put my life on hold on the off chance I may have the opportunity to extend that way in 10-15 years.
From the advice received on here (which i have to say has been fantastic, Thank you everyone) I think that if he does not want to move any time soon that we will gain a independent valuation of his house with/without the land and bash out a price from that. If its not enough for me to relinquish then I will keep it but offer him the option to use it if he wishes. I will ask my solicitor to draw up a small £1 a year basic tenancy/rental and list caveats/terms etc. I will also suggest that I would be prepared to talk to a potential new owner when he does sell way in the future so that it does not make the house too unattractive to a sale and can be listed in the particulars with the agent.
I would proceed with my initial planned barn extension. With a 2yo child and another on the way i really need more than 2 bedrooms.

If you grant him a legal easement (has to be done by deed) or equitable easement (can be done via a contract) to use the land, you won't have to talk to potential new owners as the right to use the land will pass to the new owners and they'll be able to see the easement when searches are done so long as it is properly registered.What will your verse be?

Maybe I'm just too simple, but That patch of land is currently worth nothing to OP, so I'd be saying, what's the uplift in the neighbour's value by having a garden, split that 50/50, and make him pay the legals out of his share. win, win.
I'd also be putting the kind of restrictions on use that others have mentioned.0 -
Maybe I'm just meaner than most but in my opinion, he bought the house knowing it had no back garden and a useless rear door, so tough luck basically!
I would be willing to discuss the purchase of his house from him but not the sale of any land to him.
If forced to go down the sale -of-land route (which I think would be very unlikely) I would be saying he stood 100% of all costs and fees. Also, I would be going for the full uplift in value. The only benefit to him down the line should be a quicker sale.0 -

Its been a while. Ive since had plans approved to convert my barn and extend my house into it. I have also spoken to the neighbour about the land and done as suggested and recommended he values up with/without land to give us a price to start at.
interestingly, he's also looking to sell...
he said though that he's not looked after his house because he's on his own and it needs some work. he planned to have the work done over the next 12 months then market. I suggested he gets it valued and saves his money as i would be interested.
