Fair point.
The term 'debt' and the wording of their demand letters is audacious and foundation for the legitimacy of the demand hasn't even been established when these are sent out. It's horrible because no one at HMRC claims liability for the demand. Their letters always start with "Our records show" so they can fall back on systematic error if you decide to go head to head with them.
I didn't know there was a legal definition of 'tax credit debt' 'tax', 'credit', and 'debt' maybe but I haven't came across any, but would be interested to see where this is0 -

Whilst I'm not disagreeing with you, why would hmrc ever take court action when they can simply dip into your salary or benefits when they think you have had an overpayment?0
