    Hi bb,
    I think BC have sold everybody's debts!!! Last month I got yet another we will default you if you do not pay in full letter, followed by we have put you on a plan and will charge you tiny interest and then yesterday another formal demand and a letter saying off to PRA. If I were you I would definitely hold on to the back payments for a f&f...let us know if a big D finally appears on your credit file, I will be checking mine at month end....
    Puzz.x

    I'm going to puzz, it's a nice extra Emergency Fund too. Sounds like Barclaycard have finally decided we are all bad customers after all. I didn't understand why they were fixated in retaining us as customers with the "no default" and "you will pay interest" stance.

    There is stirring in the credit file though AP has change to AA and I'm now 2 months in arrears, so hopefully the big D is coming ;)

    Yes, and No.

    A creditor still has to be able to prove you owe the debt, so would still have to provide you with something.

    If you want to continue paying the debt down as quickly as possible, then that is fine, however, if you were looking for a little breathing space, then it could be many months before Cabot decide to chase you up for this debt, or they may write to you this week, depends how much work they have on there books at the present time, they always chase the more lucrative accounts first, so may side-line yours for the time being.

    You would generally need a reference number in order for them to trace your account, if it were me, id just wait until you get the letter from them, but its up to you how you play it.

    Thank you. I did get a reference number from Lloyds when I spoke to them yesterday. I've had a proper look at the letter from SC and it says that I'm to ring them with the reference number once I've got it so think they'll sort out everything else with the DCA, hopefully meaning I won't need to contact them myself. I would like the debt on the plan as we couldn't stretch to a payment outside of it once they start chasing for it, if that makes sense. I'm not feeling very brave at the moment either and the thought of ignoring them scare me a bit! Thanks again for your advice, think I'll be picking your brains quite a bit over the coming months if you don't mind!

    It's nice to see others making progress. Barclaycard are our biggest debtor, so it's been interesting to hear how they've acted with people.

    Thanks run, great progress, do you have any top tips for budgeting ?
    Mine, sorry for those that get this every time, is to look at your food waste and try to reduce that. I now waste less then 75p worth of for per week on average. Shame on me for the 75p, but I am working in it.

    Yes Sazzie, I do.
    Check your bank account EVERY day - sometimes several times a day.
    KNOW at the start of the 'salary' month what you are paying out on in respect of bills etc.
    Include EVERYTHING. And I mean EVERYTHING!
    Calculate your remaining money and that is what you will be spending on food, fuel and fun!
    Start to SAVE money. Transfer it to an account that is difficult to access but there if you need it.
    Use budgeting software such as YNAB or a budgetting app. I use Money Dashboard which provides me over time with useful guides on where I am spending money and therefore where I can cut back.

    I need someone to help me get my head straight.

    OK, so contacted SC and have been told that i can go on a low start DMP. I've already received default notices from all but one of my creditors and my overdraft. Barclaycard (2 of my biggest debts) have been sold to PRA group. What does that mean? I can't check Noddle from over here for some reason so I can't see if the defaults have been registered on my credit file.

    So now SC are going to take over with my payments after 4 months of £1 token payments. Am I doing the right thing or should I be managing this myself?
    I am really going to look into going self managed as I am off work for next few weeks so it seems like a good time to get things sorted. SC really helped me at the start of my debt free journey over 2 years ago but now I feel I want to have some control over it . If I change to self managed would there be a period of change where my creditors don't get paid on time? That is my main worry, that I miss a payment whilst changing over .
    So not just me with missing payments to Barclaycard then Kid77!!

    PRA Group is the new name for Aktiv Kapital, there an American debt purchasing company, it just means your debt has been sold to them, and they will be in contact with you at some point no doubt.
    If your confident enough to go self managed, then do so, although if you are unsure if it would be right for you just now, stick with SC for the time being, and see how it goes.

    Yup I'm with Sourcrates, if you know what you are doing, you are confident and you have time then self managed is most likely the way to go. If you don't, and/ or as in my case, you can't be trusted, then Stepchange Or another free provider, Christians against Poverty for example, is probably a better choice.

    I am a credit addict, even knowing what I know, I still see ads for things on interest free, credit cards for bad credit etc and I sometimes think, ooh how could I do that. In fact I don't want any more credit when I realise how I've wasted my life paying it back, but I have that initial hit when I see the adverts.
    Knowing that Stepchange won't allow me any more credit is the extra step I need to keep me on the straight and narrow, and although one day I'd like to go self managed, and I have a great deal of respect for those that do go self managed, at the moment it's not for me.

    Have a good debt busting week everyone,

    P.s. barclaycard haven't sold mine, although I am on 0%!

    I didn't find it difficult to go self managed, although it does take a bit of work. I phoned all my creditors and made the arrangements and so far so good, it hasn't been any hassle.

    I called SC and cancelled my agreement at the same time as my payment went to creditors on the 25th of the month. I then called my creditors straight away and arranged payment to go out of my account on the 25th of the next month, so it didn't make any difference to them. A seamless transition!

    It does take will power though. Halifax only wanted £50 a month, and we were paying them a lot more than that when going through SC. Consequently we have dipped into that money and won't get the Halifax paid off by November when all our other debts will be cleared. Hey ho such is life!

    Hi all, can I throw this one back out. Any advice much appreciated :)

    MBNA has defaulted one lot of debt and advised it may be sold, that the recipient could litigate blah blah. It's quite bitter in it's tone to be honest, like defaulting me is a defeat for them!

    Can I just ask, if this debt which is now defaulted on is sold, will it show the new creditor on my credit file? More importantly will the debt still be defaulted debt irrespective of who it's passed around to?

    Something that could affect DMP'ers subject to court action

    --> Help stop the rise in Court Fees #saveukjustice

    Please help ask the government not to increase the fee for a general application in civil proceedings to £255

    The government are proposing to increase the court fee for a general application in civil proceedings ( the N244 application used to ask to set aside a default judgment, apply for a stay, compliance with a 31.14 request, strike out a statement of case... and so on ) from £155 to £255.

    A large number of people who receive a court claim need to use an application at some point during the defence of their case.

    I believe this is a disproportionate rise and will have a detrimental affect on vulnerable consumers and only serve to further restrict access to justice.

    I have started a petition to ask to government to reconsider. PLEASE SIGN

    Last year the government held a consultation, 96% of respondents, including the law society and money advice service said NO to the raise. Yet the government have decided to go ahead with it regardless. You can see that consultation http://www.parliament.uk/business/committees/committees-a-z/commons-select/justice-committee/inquiries/parliament-2015/inquiry-name/
    The rises also include divorce court fee rising by £140 and the maximum court fee doubling from £10k to £20k for bringing high value cases ( such as for medical negligence / personal injury ).

    I'm concentrating on the Application fee as this affects everyone who has ever received a court claim or default judgment.

    Applications are generally made ex-parte in the following situations.

    • to suspend a possession order to pay back mortgage or rent arrears in instalments;
    • to suspend a warrant of possession for rent or mortgage arrears;
    • to pay a county court judgment in instalments;
    • to vary the terms of an instalment order on a county court judgment;
    • to suspend a warrant of control to stop enforcement agent action;
    • to pay the warrant in instalments as part of the suspension of a warrant of control;
    • to ask for a stay of execution in the High Court to suspend a writ of control
    • to ask for a transfer to your local court for a hearing;
    • to vary the terms of a charging order or to pay by instalments on a charging order;
    • to apply for a time order in the course of proceedings for eligible agreements under the Consumer Credit Act 1974 (secured loans, hire purchase and conditional sale agreements and unsecured loan agreements);
    • to set aside a judgment made in error or where there is a defence to the claim;
    • to vary the terms of an attachment of earnings order or to apply for a consolidated attachment of earnings order.

    I have started a petition to ask to government to reconsider. PLEASE SIGN and PLEASE SHARE
