    This is some freeman on the land nonsense.
    Much as I'd love to give these parking companies a hard time, this tired old routine is not the way to do it.
    Anyone trying this for real with a court for any defence will soon find out which side has all the aces. And it's a sure fire way to make yourself look unreasonable, when you need to be making the parking company's demands look stupid.

    Hmmm. For a 'business man' who says he's experienced in using the small claims court and purports to know lots about the process, he seems to know not a lot (like being unsure as to whether he could defend a claim in his local court in Nuneaton, or have to travel to Preston to do so).

    Georgina, while trying to and actually being very helpful, rather sounded somewhat junior in status and seemed to me just to be going along with the conversation rather than making any substantive statements.

    I think it unfair to record her innocent conversation and not warn her that it was being recorded and was to be splattered over YouTube. I'm sure there would have been a much more guarded response to his ramblings.

    I think this guy is making heavy weather of this.

    May be, but is there any validity in that by actually appealing, you are indirectly pleading guilty, or actually admitting culpability? The court lady seemed to endorse what the guy said, as in "....as you found out for yourself.............." So which is more effective? An appeal, or a direct challenge? From a principled point of view, I'd go for the challenge. From a get-out-of-gaol point of view, perhaps an appeal is better, unless of course, you are appealing to the IAS! What about from a correct legal point of view? Comments welcome.

    The "court lady" admitted she was an admin member of staff and had no legal training.

    This was obvious by her replies regarding changing the court venue (when she tells the caller that he needs to speak to her or her colleague to get the venue changed)


    The correct answer to give the caller was that if a claim is issued that he wishes to defend he will be asked in the court's directions questionnaire which court he would prefer to deal with, and should enter Nuneaton in answer to the question and state his reason.


    It was apparent she had never read or understood the form in question which gets sent to all defendants routinely when a claim is progressing towards a hearing.


    So don't be fooled by her comments regarding appeals came with the benefit of any authority!

    Wasn't sure when I was posting whether it was literally illegal, hence the choice of a more 'neutral' descriptor. Tx for confirmation.
