smart parking at fistral beach

After our holiday in cornwall in June I was disappointed to find a parking ticket from smart parking! On the day in question we simply drive into the car park and as it was raining didn't even get out of the car whilst we decided whether or not to park, the car park was completely empty. The notice is demanding £60 or £100 if paid in 2 weeks! I've called to speak to them and the man on the phone said it was my responsibility to check the notices. I obviously explained that as we hadn't looked as we wern't actually parked! Has anybody had anything similar where you didn't actually get out of the car! Surely this is similar to browsing in a shop and not buying something?

stopped , parked , makes no difference , you were on private land, didnt buy a ticket and were clocked in and out by ANPR cameras
doesnt even matter that the car park was empty, its a honeytrap and you fell for it, sorry to say
its nothing like being in a shop where there is no obligation to pay, whereas on a car park there can be, in this case there is
this forum has dozens of similar queries on this situation, including fistral beach car park, whether it be PE in the past or now not so Smart parking

The new 10 minute period has not been widely publicised, and has caught many out since the change to SMART. PE were kicked out, supposedly because of the number of complaints. Co-incidentally, this was about the same time Rik Stein opened a chippy there.Illegitimi non carborundum:)0 -
The owner John Briant told me that the Grace period was 15 minutes now it was under the rules of smart parking.
Consquently, I was there for 16 minutes and 40 seconds and also got a 60 pound fine.
Told them I'd pay them £10 for losses and if they refused I wish to see how they calculated their loses based on a minute and a half of parking.

Nice to see that Fistral Beach remains a honeytrap for the parking industry.
However, as Smart Parking do not use keeper liability, simply appeal in the 3rd party without stating who the driver was. When they reject, appeal to POPLA on the grounds the NTK did not establish keeper liability.Dedicated to driving up standards in parking0 -
ParkingEye were kicked out due to the number of complaints. Once this is over, I suggest writing to the owner to complain, as well as the council and the Newquay voice.
The car park is leased from the council by Britanic Industries on a long lease.
