With ref my PCN which (original thread here https://forums.moneysavingexpert.com/discussion/5217381 )
Almost four months on, I have today had a letter out of the blue from the PPC, saying they are withdrawing the PCN!!
Unsure why as they have not said, but my POPLA appeal was 5 weeks overdue, I was sent final demands and DCA letter during appeal, and I have complained to BPA about them three times over this single PCN, so maybe they intervened..??
Who knows!!!
the timescales have been as follows..
31/03 alleged offence
8/4 PCN received
14/4 soft appeal sent
20/4 soft appeal rejected
26/4 POPLA appeal submitted
02/06 POPLA appeal date
01/06 evidence pack not received, complaint to BPA
20/6 Red final demand sent
25/06 Complaint to BPA about getting red final demand during appeal
04/07 DCA letter received
04/07 Complaint to PPC and BPA about DCA letter during appeal
and now
10/07 letter from PPC cancelling the PCN...

RESULT!!
Massive thanks to everyone who replied in my thread to help, you guys are stars and have enlightened me to this fowl practice...

just goes to show that its like a tennis match, keep knocking the ball back and challenge anything and everything , like hawkeye , lol
result , well done0 -
Leaned on by BPA I guess. They prefer cancellation of the ticket to having to explain their member's breach of the Code of Practice.Je suis Charlie.0

thanks for your help and advice Redx!!
Yes you are blunt with your advice, but you tell it like it is, and that's how you have to be with these scumbags, I have learnt that now...0 -
that was my point in another thread a few days ago
no p*ssyfooting around, this is serious s*** and so I make no bones about telling it as it is, no flannel, so people get the facts, and the advice they need, no ifs , no buts , no going off topic , lol
that is why I kept telling you and agreeing with you to report every breach to the BPA , by email , I am totally convinced it was your constant complaints to the BPA that got it dropped, otherwise they would have to have done something about the code breaches
plus your excellent popla appeal too
again , well done , persistence pays0 -

One of the good guys on here and pepipoo. Duly vouched for! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Redx, yeah I enjoyed that thread, found it quite entertaining lol.
Iamemanresu, what extra info do you need?
The events timeline is above, along with link to my thread which has all the info in it. Be glad to offer anything else to help the cause!!
Only thing not posted yet was my Popla appeal, decided to wait until it won before sharing, thought it's not much use if it loses, but I'll add that to my original thread tonight anyway now, if it might help others with ideas??0 -
I suspect you will get a popla decision stating that the PPC cancelled the charge, so they probably wont make any ruling , lol0
-
Maybe something in your POPLA was a hot potato for them and they didn't want an adverse ruling on that point
Or maybe they've decided you're the hot potato
Whatever the reason - well done for rattling them so much they knew when to throw in the towel0
