I am now panicking as I followed advice to ignore the letters demanding the parking fee for staying over the 2 hours. I now have a letter from Miah soloisitors demanding £275 which as pensioners we cannot afford. I was the driver that day but my husband is the registered owner. I have 14 days the letter says before legal preceding. I can see from the threads I should have appealed. Ann Robinson did have an interview about this problem and the guy said ignore the letters, however it becomes very stressful when you get these letters asking for £2750

I would suggest that anything ann robinson said is years out of date advice, especially for england and wales
if you get an official LBC or official court papers (SCC = Small Claims Court) you will need to defend yourself
doesnt matter if you are 18 or 80 , court can still apply if the PPC do everything they need to do in order to bring about a court claim
read the LBCCC fightback thread in the crabman sticky thread, possibly replying to this letter by requiring them to follow LBC protocols

I have read lots of the post on here and I am even more confused. It seems all I can do now is see if miah solicitors take me to court for the £2750

Anything from Miah is likely to be dodgy, unless they send you court papers, which is most unlikely, there is no need to worry. Read this,

Mr Ian Brill, who was fined a very large sum of money, was until recently on the Payroll of Miah, this is not a firm you need take too seriously.jYou never know how far you can go until you go too far.0 -

the NEWBIES sticky thread explains all the pointers you needed to know, especially about IPC and IAS members like UKCPS
its either pay or ignore , unless you get an LBC or an MCOL or court papers for the small claims court, that part has not changed for 18 months or so for UKCPS
ITS AS IF YOU WANTED A THIRD OPTION, SOME SORT OF GET OUT OF "JAIL" FREE CARD LIKE IN MONOPOLY, SORRY BUT THAT WAS NEVER GOING TO HAPPEN
it is what it is, you have the right to defend yourself in court, they have the right to put their case in front of a judge, that small claims court system has existed since 1973 , so not exactly news
prior to oct 2012 the advice was ignore because very few court claims were issued, and registered keepers were not held responsible , POFA 2012 changed all that, plus the recent Beavis case , so its now a different world, differnt scenarios , but similar advice because the basics have not changed
court was and is always a possibility, but they have to prove their civil case before a judge in order to get a judgment
forums like this can only try to offer the best advice on the day, you seem to expect far more0 -
Thanks for your quick response and I will send Miah solicitors an email to include as follows: I challenge this PCN as the keeper of the car and will complain to the landowner if this matter is not cancelled. I believe the signs were ambiguous and not clear for drivers to see before they park. There will be no admission as to who was driving and no assumption can be made. You must rely on the POFA 2012 and offer me a POPLA code, or cancel the charge. The driver was a genuine patron of the many shops and cafe of this parking site. I have kept proof of submission of this appeal and look forward to your reply. Do you think this letter is ok or could you give me any improvements ? Thanks again Beryl0

UKCPS dont "do" popla so whatever you ask for they are not obliged to give it to you at this stage
I dont give bespoke legal advice as that is not what this forum is about , we point you at information that you can use to decide what to do, its free advice only
its too late for you to appeal , but you can do so if you wish, it wont do any harm as long as you word it properly , although I would suggest you forget about appealing and concentrate on insisting on a proper LBC (Letter Before Claim) because its past appeal time and possibly close to court papers time
I would advise you to read parking pranksters blog dated 30 oct 2015 about ADR and IPC members like UKCPS , ALSO to read his court guide too
I also asked you to start your own thread for bespoke advice, you have ignored that request completely0 -

And they will ignore it.
Concentrate on Miah, ask them in what capacity they are acting, as a debt collector or as a solicitor. Ask them for a breakdown of their charges, copy their correspondence to the SRA.
Ask the SRA if Miah's fees are acceptable, ask them whether they think that the tone of the letter is intimidatory, ask them if Miah are behaving in a solicitory manner. Go after the messenger, they have most to lose.
There is an excellent get stuffed letter from Gan to Miah on here, look for it.You never know how far you can go until you go too far.0 -
