I went back to the BPA who said that I should have written to the lead investigator, well thanks for telling me folks. You never mentioned this at any point!!!
what annoyed me was the comment above, not the rest of the update which would have been most welcome
the comment above is disrespectful to the 3 people including myself who set out to help you based on what you told us , so its you that is being unfair - not me. you dont seem to have used the forum search to do the research which takes a minute or two to find the info you need , which is what I did earlier
you never mentioned that the popla code was out of date (easily checked using the parking cowboys code checker)
2 people at least told you to use it IF IT WAS VALID (myself and umkomaas) - so we were under the impression you had a valid code, which the NEWBIES thread tells people to check
you never came back and told us it wasnt valid
you never came back and told us popla had rejected the appeal due to the code having expired (which you should have known if you had checked the expiry)
you never asked us what to do if the code had expired (that thread I linked had coupon-mad tell another member what to do with names and emails and all sorts)
the BPA advice was correct, you should follow it (but being stubborn you have decided not to do so) - which a judge may not like if he or she questions you about it in the future
you need to be sure that you can show a judge you have taken all reasonable steps to avoid court, yet by your own admission you havent because you have almost thrown in the towel halfway through ADR !
it would be easier to try to get this heard by popla than it would a judge in court, plus if Greenslade refused it you would have better evidence for a judge too
I dont think you have thought this through, its obviously wearing you down, but a court case would do so even more, as per Barry Beavis !
3 times he has been in court, yesterday being his third in 17 months and a saga going on for maybe 28 months now. at the moment they have another 5.6 years to chase you and make your life a misery
why you would want to go through that when all you have to do is send the same appeal to Henry Greenslade and ask for special dispensation to have it heard even after the code has expired is beyond me (quoting what the BPA have told you and enclosing all correspondence to date)
sorry, but at the moment you are your own worst enemy, then biting the hands that fed you free info beggars belief
I wish you good luck in winning this case, but I fear that you are still digging the hole you find yourself in, when you see sense, you will stop digging and do what we and the BPA are telling you to do , even if it is only to save face if it goes before a judge, as you will be questioned about the ADR aspect, so when the judge asks and you say the BPA told you to appeal to the lead adjudicator , then the judge asks "well, did you ?" ; your answer will be ????????0 -
Redx I see what's happened here and forgive me as I obviously didn't write it correctly but when I said "thanks for telling me folks" I was aiming that solely at the BPA and not at you or anyone else on here so I apologise for being misleading and it looking like I was having a go at you guys which I absolutely wasn't. Your comments make sense now I realise what you thought I was saying.
For what its worth I continued to ignore their demands and eventually they just wrote and said they weren't pursuing it anymore.0
