    Okay sure, what sort of letter/email would I write to the BPA?

    Along the lines of received two letters from debt collectors, but never received the NTK's for them two. Also mentioning the fact that I've appealed five other tickets, and that it would make no sense for me to have simply ignored those two?

    Correct, send a copy of the correspondance along with a statement saying that you've received deby collectors mail for 2 offices which are still in the appeal process and ask them to impose appropriate sanctions.

    Dear BPA,
    I am the registered keeper of vehicle **** *** and would like to make a complaint regarding First Parking Ltd. My complaint is in regards to receiving two letters from Debt Recovery Plus Ltd on First Parking’s behalf. Debt Recovery Plus Ltd are requesting £149.00 for each ticket claiming that I have not paid the parking charge, but I received no ‘notice-to-keeper’ letters previously in regards to the two tickets. If I had received the ‘notice-to-keeper’ then I would have definitely appealed to First Parking, and then onto POPLA which is the case in five other tickets which are currently under review by POPLA, therefore it would make no sense for me to have simply ignored the two tickets when I had already appealed five others.
    I demand an investigation into First Parking Ltd, and at the very least, wish to have the opportunity to appeal to POPLA rather than simply being threatened with a £149.00 charge from Debt Recovery Plus Ltd.

    First Parking LLP is a member of the BPA’s Approved Operator Scheme.



    Unfortunately we are unable to prove that the operator sent out the previous letters or in fact, that you did not receive them. We would suggest that you contact the debt recovery agent requesting that the hold any further action until your appeal has been heard by the operator. Re-appeal to the operator and request a valid verification code for POPLA and ask that they instruct the debt recovery to hold further action. We would recommend that you do so by recorded delivery as proof of receipt. Should this matter go to small claims court you will have proof that you have tried to resolve this situation.

    Are the debt collectors letters for 2 completely new invoices, or are they for invoices that were already in appeal?

    If they are new, I'd treat them as NtK's and appeal them fresh, but don't send them recorded as advised by the BPA (PPC's are quite guilty of refusing to sign).

    I'm not sure what you should say in reply to the BPA.

    Two completely new invoices. I haven't received an NTK for these two.

    You should fire off the standard reply to each of them, safe in the knowledge that they'll never take you to court over 2 issues where a POPLA appeal has been successful for another 5.

    They'll no doubt tell you that it's too late to appeal, at which point you go back to the BPA and apply some additional pressure.

    Also, you've already cost them £135 +VAT in POPLA fees, with another £54 pending. Well done :)

    I forwarded the email I sent to the BPA to the DVLA; as soon as the DVLA replied I got another email from the BPA saying that they will be investigating the complaint now.

    Turns out the two debt recovery letters were for one parking charge, in which they sent two in the space of two days for the same one.

    I don't believe it! I got 4 replies from POPLA, and 4 wins! Thanks so much you guys, saved me a chunk of money.

    I've still got one under appeal, and one in which I need to send off to POPLA. For the latter, can I refer to the winning appeals within the appeal itself?

    I've also got the one I didn't receive the NTK for under investigation by the BPA and DVLA, but I'm still receiving letters from DRP. Should I inform the BPA/DVLA of the winning POPLA appeals?

    1. In regard to the one you need to send off to POPLA - things have changed from this week on. Please read this link, which explains how it will function in future and read the sub-link contained in the piece to give you information about registering your intention to appeal (but it won't be dealt with until around October). You must make sure you register before the POPLA expiry deadline for that particular PCN - you're going to have to move sharpish by the sounds of things on that.

    2. If DRP are chasing you - COMPLAIN, once again, to the DVLA and BPA.

    3. On what grounds were each of your 4 POPLA appeals upheld?
