    The Independent Appeals Service (IAS) has received a decision from the Independent Adjudicator regarding your recent appeal. Please see below for the full details.

    Appeal Outcome: Dismissed

    The Adjudicators comments are as follows:

    "The Appellant claims they purchased a valid parking ticket and attempted to display the same. However, due to difficult circumstances on the day, the ticket became dislodged.

    The contractual terms advertised on the signs at the site make it clear that any driver parking without displaying a valid ticket will be issued with a parking charge. The Appellant accepts their ticket was not displayed; therefore the parking charge was legally issued. I accept the Appellant is a genuine ticket holder, and they have my sympathy, but it is always the driver’s responsibility to ensure the ticket is displayed, and will remain displayed when they leave the vehicle. As the guidance to this appeal explains I can only consider legal challenges, not mistakes or extenuating circumstances.

    "

    As your appeal has been dismissed, the Independent Adjudicator has found, upon the evidence provided, that the parking charge was lawfully incurred.

    As this appeal has not been resolved in your favour, the IAS is unable to intervene further in this matter.

    this week all of the sudden I have received two letters.
    One is from TNC Parking services ( outstanding parking charge notice ). Letter dated 10th September, asking me to pay £145 and if I do not pay it will result in referral to their Litigation department.

    Then the day after I received another letter, dated 16th September. from the BPA asking me to pay the £145. If I do not pay it in 7 days they can be collecting the money by taking any of the following relevant action against me.
    1. court order against my earnings
    2. seize assets
    3. court order
    4. seek and order against me
    5. they will declare me bankrupt.

    I am really worried and upset with this.

    What do i need to do now??? Carry on telling them that I paid for my ticket, that the ticket was in the car and because of the wind couldn't be visible. Or do I pay the fine?

    I appreciate your help with this

    Please check the name on the letter as BPA is the British Parking Association! they have nothing to do with Armtrac.

    These are out and out lies. Please clarify who the letter is from as it cannot be from the BPA. Please scan and post a redacted copy of the letter for us all to laugh at.

    TNC are chocolate teapots...but with a BIG mail and phone budget.

    Email once stating that the debt is denied and that the charge must referred back to the principal
    1) A valid ticket was purchased
    2) The charge was not a genuine pre-estimate of loss
    3) No contravention occurred (this will depend on signage, but some armtrac car parks do not mention that tickets must be displayed)
    4) The charge is an unfair term in UTCCR 1999 (soon to be CA 2015)
    5) The signage did not contain the information needed for a distance contract

    Also inform them that they are in breach of the Consumer ADR Act, para 19.2.
