if you disputed the data, did you think they would just delete?
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

All credit agencies are members of GAIN (Gone Away Information Network). In summary it's a way of monitoring accounts for delinquent debtors. As soon as the debtor resurfaces and a new address is known the DCA's can go chasing.

So assuming as you say that the debt is not yours....

Dispute with the collector and bank, probably focusing on whichever owns the debt and has the credit report entry recorded under their name.

You will have to emphasise that

    - the debt is not yours
    - that by recording an inaccurate account and default for a debt that is not yours, they are in breach of their obligations under the Data Protection Act.
    - that unless they investigate and remove the account and default form your reports, you will be taking them to The FOS and reporting them to the ICO.
    - that unless they stop the debt collector chasing a debt that is not yours you will be reporting them to the FCA.

May also be worth having a word with the FOS straight away, as often they will agree to write a preliminary complaint for you even at an early stage before they can formally take the case on.

    1. talk to the business first

First, give the business you’re unhappy with a chance to put things right. They have up to eight weeks to give you an answer.

If you’d like us to contact them for you, just get in touch.

A letter from the FOS at an early stage can work wonders with awkward companies. ;)

That is really useful thank you. The bank is Santander i closed the account several years ago. Since then i have moved and gain credit several times including being told by a rental agent that credit check was the best he had seen in a long time.

After moving recently applied for credit for a new bed and turned down all of a sudden so checked through Noddle and lo and behold 4 months ago all of a sudden santander have a default and debt of £500! Never had a loan or card with them only basic current account years ago with no overdraft!

It is not my debt thats for sure.

Most helpful about the fos i will get on that straight away.

    OK then.

Formal complaint can also be emailed to ceo@santander.co.uk

Sometime emailing that address gets quicker results and attention, sometimes it doesn't, but worth a shot in parallel with anything else you do.

Interesting. Was that as a result of the recent push by Experian to drag in the rental sector to credit reporting? Normally rental agents wouldn't get to see actual credit data held against you.
