Noddle have given my personal information out?!

Hi all

Can someone tell me if Noddle.co.uk are allowed to pass your address details on? I recently applied for my free credit file. I found a default and debt that i don't have (!) So disputed it with them.

All of a sudden within 2 weeks i have had a letter from a well known debt collection agency requesting payment of said debt!

Before i contact Noddle i wanted to know my rights please?

Also should i reply to the DCA or the original bank that have without a doubt made an very weird error!

    When you signed up with Noddle you agreed to their T&Cs, including their Privacy Policy, which allows quite wide sharing of the information you provided.

    If it hasn't been sold, I'd go to the (original) creditor. If you go to the DCA they will refer back to the creditor anyway, so you'll cut out an extra layer of complexity.

    If the debt has been sold, the original creditor probably won't be very interested and you'll have to deal with whoever has bought it.

    Yes, you agreed to allow them to share your information with "selected third parties"
    In other words debt collectors.
    This is how they make their money.
    Nothing in life is free, it is a free credit search with a sting in its tail.
    They grab the new details and forward them to debt collectors who pay for the running of the service.
    A Honey trap sums it up perfectly.

    All three CRAs Equifax Experian and Callcredit/Noddle share data with debt collectors for tracing and collection purposes. You agree to this whenever you request a report from ANY of them.

    Has nothing to do with Noddle being free. Its just how CRAs work.

    So according to that, if you never sign up for a report, they can't share data about you with debt collectors? I didn't think it worked like that.

    Erm, no.

    Your vision is impaired by the red mist you see every time CRAs are mentioned.

    They can share what they have already have under the 'legitimate interest' provisions of the DPA, and under consent where that may already have been obtained with that via applications etc. Does not mean that you shoudnt be warned about and agree what may be done with additional data you supply when making a credit report application though, but it does not prevent them sharing what they already have from other legitimate sources.

    ....so long as you add on 'never apply for any service or product that involves a credit check' as you probably sign similar rights away when that happens

    Yes, consent to share is given in most places like that, and legitimate interests covers most processing and sharing if not. They interplay, otherwise CRA files could not work or be useful for anyone.

    This post is misleading, as I thought, and as others have gleefully pointed out as they imply (wrongly) that I don't understand how it works.


    Just to be clear, you don't explicitly give them authorisation to disseminate information about you to debt collectors when you order a report. However, on CallCredit's free service I guess you give them carte blanche to scatter your data like confetti.


    I do wish people would stop advising others that access to the CRA files about you is contingent on your consent; it isn't. The "legitimate interest" argument is so ill-defined and wide open that very many organisations can access CRA files about you without your consent.

    What if you send a letter and postal order for a limited subject access request? You are not giving any extra consent to give data to 3rd parties unless you agreed already with the third parties you have credit with.

    If you apply online or using their form, they sneak in extra small print.

    They do however update your credit file with any info you give when you ask for your report.

    So, you cannot find out what is on your report without adding to it.
