PCN from Elite Management

Hi,

I've had a Parking Charge Notice from Elite Management (Midlands) Ltd, and after reading through various forums and threads etc have been looking at the 'sticky' advice on here.

I have a question... the advice is to :-
1) "appeal online or by email at around day 20 after a windscreen ticket but as the KEEPER", 2) "The reason for waiting 3 weeks is to not appeal too soon as if you are the driver and secondly, to engage them in the appeals process at a time when they should also be posting a Notice to Keeper"

Why not wait until say day 25 to appeal when the PPC is even more likley to forget to send a NTK (by day 56?).

Also by appealing, does that essentially give them your keeper details without the need for them to go to the DVLA?

    by all means wait until day 25 if you wish

    just send it with a free certificate of posting from the P.O. between day 21 and day 25 , as its deemed delivered 2 days later

    you are appealing as keeper, so they should still send an NTK to abide by POFA 2012, if they dont, its an added appeal point (so dont explain matters to them)

    I plan to email it not post it - no need to waste hard earned money on them :)

    So even though I provide them with my address, they still need to send a NTK by day 56.... shame it makes their life easier by providing the address up front so to speak.

    I might way between days 20-25 to email them, unless anyone thinks this is not a good option (and if so why?)

    You are dead right - but the reason why I don't say 25 days is because human nature would mean people would leave it another few days or they might just post their appeal (soooo many newbies pointlessly POST a letter to PPCs that have online appeal!). If newbies then missed the deadline they've mucked up, hence why I say day 22 to ensure even slower appealers don't muck it up.

    Your plan is fine! As you have your head around why you are doing this you could even email or do an online appeal (as long as the PCN allows email) on day 27.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    are you ASSUMING you can email them with an appeal ?

    or do you KNOW you can email them an appeal

    many dont accepts email appeals, so only do so if the NTK or PCN says you can (or their website)

    IF THEIR WEBSITE ALLOWS ONLINE APPEALS, use it

    if in doubt, post it with free certificate of posting at the P.O.

    Not an assumption at all.

    The appeal process on the back of the PCN clearly states "you should submit your case in writing or email (addresses on front of Notice)"

    And on the front there is a line about appeals and what email address to use

    There is no online appeal process (not on the PCN), but I'm under the thought, if the PCN does not mention an online process, and there is one, don't use it - clearly if they want you to use an online process they should tell you on the PCN

    Also a little confused.
    A windscreen ticket is a notice to owner/keeper right?
    So why do they have to send a NTK after 28 days (but within 56 days), asssuming they remember to do so whilst the appeal is ongoing?

    no, a windscreen ticket is a Notice To Driver (NTD), seeing as the DRIVER would see it on their return to the vehicle, so they would NOTICE it !

    a NTK is sent in the post once the keeper details are known by paying for them with the DVLA

    THEY HAVE TO GIVE THE DRIVER 28 DAYS TO APPEAL, AFTER WHICH THEY CAN PURSUE THE KEEPER (in England and Wales) , they cannot apply for those details for 28 days

    if they allow email appeals, do so but try to make sure it is acknowledged, or take a screenshot

    Shame you have to supply your address when appealing as the keeper initially - means they don't have to pay the DVLA to get your address :(

    I'll be requesting a delivery receipt and read receipt when I send the email, both of which should automatic (though the latter can be 'switched off').

    Also, in the appeal email I was going to add a line that states:

    "Acknowledgement of this email must be made within 2 working days, otherwise it will be automatically considered that Elite Management no longer wish to pursue this matter further and the issue closed with no further action from both sides"

    That way, they have to acknowledge the appeal was received in time, and also gives me proof that it was within 28 days that the appeal was sent (if I sent it on say day 22)

    Or should I just leave it out and stick with the template in the newbies section?

    the BPA CoP allows 14 days to acknowledge and 35 days to send a decision

    I doubt that anything you write that is different than the above would have any sway at all , but adding the BPA CoP rule is fine

    But that's the whole point of a keeper appealing (as keeper) a windscreen notice (NTD). If they don't apply for keeper details from DVLA in the prescribed time frame then they've waived their claim to keeper liability. By the keeper providing these details towards the end of the driver appeal period they usually forget about getting them from DVLA. :)

    So even though the keeper (me) provides my details, they still have to go through DVLA to get them?
    How would you prove that they did?
