Restaurant wrongfully charged & now want money back

Mate of mine went to a restaurant on Saturday night with his g/friend. They were served by a new waitress who accidentally spilled ketchup over my mates new shoes! & then when they went to pay she refunded them the money instead of charging them.
They did stay in the bar part of the restaurant & had more drinks after
They have now had the restaurant ring them, had their contact details from the booking, they we're extremely rude & demanded the money back, making out my mate hadn't paid
They were going to give the money back but because of the rude call they received they are reluctant to as it isn't their fault the waitress made the mistake & the restaurants attitude was awful
Where do they stand?

They knew that they hadn't paid and had actually been given money as soon as the transaction happened so cheekily hoped the restaurant wouldn't notice! Of course they have to pay.Lost my soulmate so life is empty.

So what are they saying should have been done then if the waitress made a mistake?
I take it the shoes were salvageable and weren't ruined?
ETA: sorry misread the first time. Didnt realise they hadn't been charged AND had been credited a further amountYou keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
making out my mate hadn't paid
But your mate did not pay as the cost of the meal was refunded instead of charged so in my books it is theft as the meal was had but not paid for.
The ketchup on shoe side of it is something that {if needed} should have been taken up with the person in charge that night. I think if I was in charge of the restaurant {manager/owner} and found out for whatever reason someone had left without paying for a meal I would be reacting the same way as your mates restaurant.0 -
Always a "mate" ...0

of course they should repay the money and pay for their meal. If the waitress had charged them twice they would no doubt be expecting the restaurant to rectify the problem.
Stealing is not OK even if you have a rude or clumsy server. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
If it was the other way round, they had charged you twice what they should have and you didnt spot it. Would you have the same attitude? That you arent due a refund as you made the mistake for not spotting it?
You had goods/ services at an agreed price and therefore are liable to return the accidental refund and pay for what you agreed to pay. Obv check with the bank it is the case first though0 -

I think the title of the thread would be more accurate if it was
I wrongfully charged a restaurant and now they want the money back0
