Car bought with illegal tyres even though advert stated all tyres are good

    Most likely, but as you have not offered the dealer the chance to rectify the situation, you have no Legal re-course, that is the law unfortunately.
    How would you prove what you are claiming ?

    Before you have a, "think of the children" moment, have a look at what is acceptable to pass an MOT on tyres. You will be stunned.
    If you want to get het up and complain to someone, write to the DP at the Jag garage. Making people think, incorrectly, that their cars are both dangerous and illegal puts them down at the level of smoke detector salesmen who shout, "FIRE" through pensioners letter boxes.
    At least you will feel better that your car has better rubber (as long as they're not Dunlops).

    Also as stated above why go to a main dealer that would obviously over charge on an item that can be replaced at a fraction of the costs elsewhere.


    Nothing obvious about it. My Mazda dealer supplied and fitted tyres for my RX-8 for the same price as quoted by an online tyre retailer.

    That will be a few and far between thing then as most main dealer garages are priced up more on most if not all services and items supplied.
  • Unfortunately for you, the correct procedure you should have followed was to take the car back to the supplying dealer, point out the problem and allow the dealer to correct the problem.

    By doing what you have done, you have undoubtedly lost any possibility of getting the supplying dealer to foot the bill for the new tyres.

    Cracks don't necessarily mean the tyre is illegal....
    Agreed. I had an advisory on my MOT for cracks in the tyre tread earlier in the month.

    Whether they are dangerous is a bit of a judgement call.

    BMW dealers must have the same problem - I left my car in with my local dealer to update the Sat Nav and when lifting the keys, the salesman asked did I wish to book it in to get the tyres replaced as the front two were almost completely worn and the back two weren't far off it.

    Strange, I told him, as we had only bought the car about 2 months before that and had gotten brand new tyres put on before taking it off the forecourt.

    Even stranger was that when a fault appeared a few months later and we left the car in, a different salesman said exactly the same thing again - brand new tyres needing replaced after 5 1/2 months / not even 4000 miles? I think not. :eek:

    We lost all confidence in BMW and afraid of what else electrical might go wrong, or what they might fabricate was wrong, we sold the car very soon after this.

    I know I will be shot by the dealers union on here, but if the OP hadn't replaced the tyres, it should have been the dealers responsibility. It is all very well saying the buyer should check, but buyer beware should only apply if the dealer doesn't mention the condition of the tyres or any other part.

    Once a dealer describes any part, including tyres as being in good condition, especially when said dealer knows that tyres are expensive for a premium car like a Jaguar. It is the dealers problem if they haven't bothered to check the car properly.

    If a dealer isn't sure the tyres are in good nick, they shouldn't put that they are in good condition in the ad.
