Car bought with illegal tyres even though advert stated all tyres are good
Hi,
I just bought a used car from a trader, the advert stated that all tyres were in good condition, but we had it checked a couple days after we bought it at our local Jaguar dealership and the report stated all 4 tryes were either illegal or in bad condition with cracks in the walls, we just had to replace all 4 tyres at a cost of £600,
Can anybody shed any light on what the legal position is here to reclaim the money back from the trader for the replacement tyres. And point to any links with the legislation that may be relevant.
Also once we got home we noticed the spare wheel missing, I guess this should have been checked by us, but we didnt think to look to see if the spare was there.
Thanks for any help in advance

Going to a dealer to ask if your tyres are O K in my mind is like going to Kwik fit to see if anything needs doing to my car!I used to be indecisive but now I am not sure.0

Checking tyres is one of the easiest things to do before a purchase! If they were that bad, why didn't you notice before you paid?0
-
As others have said - why didn't you check the tyres when you viewed the car prior to purchasing it? Prevention is better than cure...."You were only supposed to blow the bl**dy doors off!!"0

there were cracks to the inside walls, and cracks in between the treads, very hard to see unless you have the car on a ramp and technically knowing what to look for,
We did check the tryres, but could only see that the treads appeared to be legal, its the stuff we couldnt see, and was very hard to see that makes them illegal.
As the cracks wer on the inside walls .. there could be a possibility that the tyres were swapped around to hide this fact. The outside walls all looked fine.0 -

There is no "legal position"
Tyres are consumable items and opnions on tyre condtion are subjective opinions at best.
If you had obtained a independent inspection from an expert as to condition and safety and gone back to the dealer you might had a chance.
Independent can not be someone selling you any products or service.
Why not just buy from the Jaguar dealer in the first place if you expected the car to be prepared to main dealer quality ?I do Contracts, all day every day.0 -
You should have gone back to the dealer and sought a resolution as by going elsewhere they can claim the work was not required, You can call them ask them to offer a gesture of goodwill but I very much doubt you will receive anything after proceeding with a replacement.
Also as stated above why go to a main dealer that would obviously over charge on an item that can be replaced at a fraction of the costs elsewhere.0 -

I know what you are saying, but we didnt get the Jaguar dealer to change the tyres, they pointed out and showed the problems where the tyres were illegal when the car was on the ramp, and we took the car away and ordered from black circle tyres of the internet ..0 -

I agree with this - if the tyres were so bad surely you would have seen it?
I think you will have no recompense speaking to the trader now as you should have gone to them first with the report. I imagine because you didn't buy from Jag direct, they've seen the car, did a big draw of breath and decided to scare you into replacing. Why would you get an expert to look at a car AFTER you've bought it?
Having dealt with a Jaguar dealership before, my experience leads me to believe they're notoriously bad at both over-exaggerating and overcharging for works. For example, almost new Jag bought from them from new, at the first yearly service they tried saying that all disks and pads were completely shot and wanted to replace for around £800. Took it to a local indy, both pads and disks were fine and had around another 2000 miles left on the front ones, back ones longer.0 -
Cracks don't necessarily mean the tyre is illegal...."You were only supposed to blow the bl**dy doors off!!"0

Didnt expect the car to be main dealer prepared quality, but when an advert says very good tyres, and its from a trader .. then you kind of expect the tyres to be very good, not illegal and dangerous.0
