HELP Private parking ticket one year later

Hello,
I wonder if anyone can help me. Parking eye have sent me a letter stating they are taking me to court for failure to pay a parking fine from May 2014. They claimed I parked in Morrisons Stratford without paying but 1. they never sent a notice last year and 2. The person who drove says he never stopped in Morrisons - he drove in and changed his mind and drove out. He says he remembers clearly because he was meant to meet a friend inside Morrissons but he got called to drive out as his friend was outside Morrissons. How can they be allowed to do this?
Can someone please help as this is stressing me out at how this system can allow rogues to commit legal fraud (assuming they are allowed to do this!)

How easy would it be for you to pop in to morrisins and have a word with them?
Morrisons can stop parking eye, you need to be firm hold your ground and above all be polite.From the Plain Language Commission:

What exactly have you received from PE - is it actual court papers issued by Northampton Bulk Centre, a Letter before Action (aka LBCC) or just a letter saying they may take you to court if you don't pay?
Have a read of the sticky thread NEWBIES - read post number 4 and especially look out for the paragraph that starts "...and here's a case (link below) where a strong response to ParkingEye when they were nearly at court stage, pulled it back to a POPLA appeal stage"
In addition complain to Morrisons head office - see post number 6 or the NEWBIES thread for contact details - they have a good record for cancelling these especially if you are a regular customer even if no-one actually was on the day - receipts, bank statements (blank out personal details though) etc
p.s. if you pop down to the store take a copy of the letter from PE - don't hand over the original you may need it and the reference numbers on it0 -
If you haven't yet received court papers you can provide PE with the name and address of the driver. This effectively resets the clock, they chase him, but, importantly, he has the opportunity to appeal the charge at POPLA and with an excellent chance of killing it.
If you've actually received stamped court papers, then you've got to get on with dealing with them yourself.

Thank you for your replies.
I contacted Morrisons and the manager Abul said there is nothing he could do and I have to liaise with Parking eye.
The letter subject is "LETTER BEFORE COUNTY COURT CLAIM". It says on 24th June 2014 they notified me that on 14th May 2014 I breached the terms and conditions at Morrissons Stratford car park. I didn't receive anything!
I'll look on the newbie thread and see what I can do. It's all so confusing and frustrating!

we are seeing quite a few "out of the blue" court claims where people have not heard anything until this letter.
They can not all be liars, I think this firm need to be put on the "gone rouge" list.
First it was no popla codes now its LBCC turning up without any other letters been sent.
Obviously as they have the courts in their pockets they must feel they can do as they like.I do Contracts, all day every day.0 -

Abdul was lying to you, go back and tell them to cancel, don't ask, tell them.
As principal, Morrisons are responsible for the actions of their agents
Do not take the nothing to do with us you have to contact the parking company as an acceptable answer.
Even if court papers are issued the principal can still step in.
You could even say that Abdul at morrisons has deliberatly lied to you in order to mislead you into paying a third party company money it does not deserve.From the Plain Language Commission:

Yes I did read it. Thanks. I've googled to find out the CEO of morrisons (David Potts). I will be writing him a letter. As well as writing parking 'lie' to inform them that I wasn't the driver. I just read from the newbie post that it is not too late to inform them of the driver's details. Is this still true (I mean has the law recently changed).

You can name the driver at any time before they issue court papers. Tell them who was driving NOW in case they decide to rush through a court claim.0
