Can i get a refund on a kitchen that i haven't received yet?!

I'm going through the process of having a new kitchen fitted. As project manager I've been planning and arranging all the tradesman to attend at key stages so far no work has been undertaken!

But I'm not happy with my kitchen fitter his communication has been poor and also he has over charged me heavily on certain items. This is Limited company. I've paid a deposit of £2000 via bank transfer on 3-6-15.

I'm I entitled to refund, under the sales of goods act 1979?

I have not received an receipt nor any form of contract.

    As he hasn't performed a service yet (and so you can't claim a refund due to work performed), whether you can get your deposit refunded depends on what the paperwork you signed with him when giving him the job.

    I assume you do have paperwork for something that required a £2k deposit? You did check other work he'd done, obtained references to avoid a situation like this?

    In future, pay at least £100 by credit or debit card, so you can get the money back if needed. Direct bank transfer is never a good idea, as no added protection.

    He has purchased and pre built the units ready for fitting also I have not signed for anything nor received any paper work. All I have got is a basic rundown of costs sent via email for example fitting £1300, units £4000, plastering £500 etc.....

    It's a contract, signing paperwork means nothing. Actions can also make a contract, in this case you have paid a deposit, this is a clear intention to form a contract. You also have an email trail, there is no doubt you are in a contract, the ins and out of this would be for a court to decide.

    Just out of interest, did people have the same rights when the SOGA 1979 came out or has it been added to?

    I can't remember people quoting it back then like they do now

    Just to note if you paid £100 by debit card, the most you would get back (providing you were able to make a claim under visa/mastercards own chargeback system) would be £100. Section 75 protection only applies to credit.
