Holiday pay after maternity leave if not returning to work

Options
I will be handing in my notice next week after 11 months maternity leave.

I used all last years holiday (runs Jan to Jan) but have accrued holiday for this year.

I believe I am legally entitled to be paid for this holiday but can my employer get out of paying it to me?

I think, in your letter of resignation, it would be worth stating how much accrued leave you believe you're entitled to and asking them to confirm that this will be paid with your final salary.

That way they have a chance of arguing with you if they disagree. But you're right, so if they don't pay we can advise what to do next.
