Last October I stayed at that hotel and noticed that just across the road APCOA had parked one of their vans with its camera pointing towards this lay-by. I can confirm there is signage saying that you can for drop-off and pickup, and the hotel's website also states that. But there are also yellow lines painted in the lay-by. So, on the one hand, the hotel says you can stop there , but on the other, the PPC says you can't .What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Can you not get your Trade Association onside? I do not imagine the Hotel would welcome a boycott of the hotel by cab drivers.You never know how far you can go until you go too far.0

MY MISTAKE. its not novotel but the ibis hotel. iv spoken to a member of staff at the ibis who told me "it is a designated drop off pick up zone" and the hotel have spoken to apcoa about ticketing there and apcoa have told the hotel that they will only issue a ticket if the vehicle is sticking out of the layby into the main road going through. on the pics iv been sent u can see clearly that the car was parked correctly, close to the layby kerb and no other vehicles were in the layby...
so now I ask again "do I ignore or do I write an appeal?".can I just call the number on the pcn and explain?. I got the pcn 11 days after the pics were taken.. thanks for all your feedback and im sorry to those who get annoyed over things they fully understand that I dont0 -

If you want to appeal you can write to them stating that your vehicle was properly within a designated pick-up/drop-off zone for the hotel (get pictures of the signs) while the driver was dropping off a fare, and their own pictures show this.
Do NOT reveal who was driving.
P.S. Google Streetview saves you a visit to photograph the signs!

appeal in writing it is then.oh how I hate writing letters.it how do word it without saying I was driving. but so be it.. as for my fellow work mates,well all they would do is moan about why I got the fare and not one of them in the first place lol. jealous biatches at time us cabbies. thanks all again0

Signage has no operator identified. Presumably, on that basis, any AOS member could rock up and start taking photos and issuing 'fines'.

phoning private parking companies or debt collectors never works, only a fool phones them and nothing good ever comes out of it
so when writing the appeal, base it on the TEMPLATE in the newbies sticky thread
the extra wording mentioned above is where you do not say I, so in this case YOU are not the driver, so assume I am the driver , I am telling you what the signs and markings say
so you say things like
"The driver says that the signs there say blah blah" etc
the word I is never used, its that simple
so assume that I was driving and you are relaying what YOU have been told as Registered Keeper , plus any pictures as evidence that I have sent you
also, make sure you TAKE this letter to the Post Office, queue up, and ask for the counter staff for a Free Certificate of Posting, to prove when you sent this appeal in, and the date it was sent in
DO NOT just drop it into any old letter box for royal mail, but get the free proof of posting
that way if it goes pear shaped and they set the dogs on you, you complain to the BPA , with copies of all paperwork and a copy of this free proof of posting

I've virtually written it for you above. You don't need reams of crap, the only point APCOA might cancel it on is that the vehicle was properly stopped within the designated pick-up/drop-off area, as shown by the photographic evidence. All the other stuff they will reject, so there's no point in writing it.
This is all you need:
The vehicle was properly stopped wholly within the designated pick-up/drop-off zone for the hotel whilst dropping off a fare. The signs (image enclosed) clearly show that this is a designated drop-off/pick-up area, and your own photographs clearly show the vehicle fully within the area and not on the roadway.
If they do reject despite the photographic evidence then the heavy lifting comes at the next stage, PoPLA.Je suis Charlie.0 -
well its been 35 days since the letter of appeal was posted back to APCOA. nothing has been sent back from them. does this mean they are not taking it further or can the driver still get a surprise ?.
five times in July I was at BHX Birmingham airport and every time I was there the APCOA camera van was parked up opposite the ibis hotel with the lens fully erected and pointing at the lay-by. they must be PCN ing everybody who uses the lay-by ?0 -
Nothing should ever surprise you in this game.
You could write to them saying that as they have not responded within the timescale you deem the matter closed.
But the '35 days' has become a bit more of a moveable feast since ParkingEye muddied the water some time ago about needing more time to assess appeals/needing more information from the motorist. So I'd hold off just for now and see what another week or two brings.Please note, we are not a legal advice forum.
