Hello all. im a cabbie from Warwickshire and iv just had a pcn (1st ever one) from apcoa for dropping off outside the novohotel at Birmingham airport (done many times before) the signs outside the hotel state the layby is for hotel pick up/drop off only and the hotel website states they have a drop off pick up zone right outside the front door for hotel customers. I want to appeal and I think iv got a good reason to but where do I start ? do I just call the number on the pcn or do I put it in writing ? im a little worried and I get very confused with some posts on the subject here, also im slightly dyslexic and im worried about bailiff threats etc if I just ignore it, so any good advice is more than welcome. thanks steve

no bailiffs will call unless they take you to court, you lose, then you dont pay the judgment set by the court within 28 days
it is after that they seek enforcement by bailiffs, so unless all this happened then why worry about bailiffs ?
in other words, you are worrying without reason, as its hasnt even been to court yet
read the NEWBIES sticky thread, and appeal as keeper (do not name the driver or infer who was driving)

I disagree with redx. If dropping off is allowed, I would appeal on those grounds. Dont say who the drive rwas..But first contact the hotel to get them to cancelDedicated to driving up standards in parking0

I would agree with hoohoo in this case. However, you have a little time to get in touch with the hotel.
In addition, what was the date of the "offence" and the date of the Notice to Keeper? And are they pursuing keeper liability under POFA 2012?0 -
APCOA effectively abandoned using POFA at Birmingham Airport over a year ago and if the arrival of their paperwork seemingly conforms to POFA then, I suggest, that's rather more by luck than judgement. They are easily beaten at POPLA so even if the OP's conversation with the Novotel fails there is every reason to think he'll succeed in appealing to APCOA and then POPLA - provided he sticks to timescales.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Frankly you are pretty safe just to ignore it. APCOA don't "do" court and even if they decided to change the habits of a lifetime they're not going to start at an airport where there is no keeper liability.Je suis Charlie.0

I wasnt considering the actual location of this "dropping off" bay as its been discussed many times before on here and I have never been to that location so I leave that to others who can advise on that aspect better than I can.
just that the location being an airport means that to me the driver should not be named in any way , shape or form , and this OP could easily "drop himself in it" with incorrect wording that "outs" the driver, because that is a common mistake to make
so all I am saying is that if he adds to the template appeal he has to be careful on the additions he makes, because the vast majority of people who make additions tend to word it in the first person
but by all means use any and all good information to defend any appeal, but dont shoot yourself in the foot whilst doing it
so I think any additions to any appeal should be closely vetted and scrutinised for the inevitable first-person mistakes
then take it to popla when they refuse the appeal , especially as if he is the RK there is no liability because POFA 2012 does not apply so they should not have obtained the RK details0
