    Hi all who have replied.

    1. Adult dependants grant is calculated using residual income, this is my wife's wage minus any previous contractual expenditure and various other disregards. (My wife's residual,income I 1800 per annum according to the calculation.

    2. Child care costs are not being included as we do not qualify for them to be counted as I am not in work or in eligible to work.

    3. They have taken the adg over 52 weeks and I have bow sourced the relevant legislation that forces them to do that.


    All in all after finding the legislation it W's an error on my part bot the council's. That being said I they are still reviewing the payment as they may have taken the adg over 42 weeks previously.

    Glad you've posted this thread as I'm hoping to get back to uni in 2017, possibly next year depending on a few things.

    I wasn't sure if the ADG is counted as income over 52 weeks, I think the maintenance grant maybe as well but it's not clear from the link you posted or the one I found.

    Now that you know how each grant/loan should be treated, it should be easy for you to double check that the correct disregards have been applied.

    The one I need to find out is about travel costs being listed as being disregarded. Also have a couple of questions of my own but will start my own thread later.

    Hi guys,

    So a quick update.

    As I posted yesterday I had accepted that the adg was taken over 52 weeks and that my entitlement was as such reduced to the number given by the council.
    I had researched the particular regulation myself and was quite happy that the decision of the council was correct.

    Today I have received a phone call (my wife took it) stating that my challenge was correct and that adg should be taken over 42 weeks. They have recalculated and reduced my entitlement by 7 per week for the preceding weeks and increased for the 10 week period to 83 per week.

    They actually asked to pass on thanks to me as they had been calculating incorrectly for all students.

    Now I find myself In a strange position in that, u believe this new higher calculation is incorrect, and that there original calculated amount was in fact the amount I am entitled to.

    Now I accepted there decision yesterday (following advice from the wife that I am a layman and they know what there doing) should I carry on to heed that advice and potentially have a large overpayment?

    Cate, you can download the act that the housing benefit office use for guidance on student claims from legislation.gov.uk.

    The act is housing benefit regulations 2006 and there is a whole section pertaining to students

    Glad you've got things sorted, if there is an overpayment they should let you pay it back at an amount that doesn't cause you hardship. It might not be very big though if it's the difference between adg being counted over 52 weeks instead of 42.

    Thanks for the website that has the regulations on it. If I go back to uni in 2017 then we'll be on UC which I have questions about but I'll start my own thread to ask.
