When you say 'Deeds', what do you mean? The Land registry Title & Plan? Or a paper Conveyance? Or something else?
What would be the address of the property identified by the 'Deeds' Plan in yellow over the road? Have you done a LR search for that address?
That looks like a similar arrangement: a 'shop' (?) attached to the side of a house. Is it? Maybe that's what they bought all those years ago, and they just moved into the wrong building...... and stayed!
Its a paper conveyance that was done in 1987 with a conveyance map attached as well. However it was never registered with the land registry.
The bit in yellow is not a building its a drive way for another property. Which is why we are also confused as it looks like they bought a drive....
We know the address for the house the drive way belongs to and is next to and it is registered with the land registery.
However interesting bit is the same women who sold them that house also sold this shop to the other people. This lady owned our whole row of houses at one point and some over the road.0 -

If so, the conveyance should have been registered.
I would also be looking at the LR Title & Plan for that other property.
And talk to 'the lady'.

Hi that pdf says 1988, however that conveyance is dated 1987
Sorry that i worded it so confusingly ill try and explain it again.
Essentially this lady (Woman A) Owned our whole row of houses including the shop and the houses down where the yellow blob is.
This woman A sold our house to Couple A in 1977 and then woman A sold the shop to Couple B in 1987.
I bought the house of Couple A in 1988.
Woman A also sold the house who's drive that is covered in Yellow to Couple C sometime in 1987-1992. Not sure of the exact date.
Their is only one shop (the one that is attached to our house) The yellow bit of land that their conveyance is claiming is the shop is actually somebody's driveway.
Does that make any more sense? Thanks

Business rates for the shop but any actual split would have taken place before business rates came in to existence (1990). The problem is that the council won't give out records and very likely won't have records going back that far. The split would also have pre-dated the start of council tax so there's unlikely to be any records remaining with the council from that side but if the property has always been listed as business use this sort of record wouldn't exist anyway.I wonder who's paying the council tax for the shop and when/if the council split the bill with the house... ?
That being said, you can check if a building is registered for business rates (the description of the property can be quite obtuse at times - XX at the back of XX street or similar) - http://www.2010.voa.gov.uk/rli/en/basic/findI no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
As for council tax we have checked and business rates are being paid on it. The shop seems to have its own address everywhere except the land registry where they say that it IS the house.
I think i have seen a land registry rep around here somewhere does anyone know how to summon them?0 -
The Land Registry rep. people seem to come on during standard office hours (ie 9-5 Monday to Friday type hours).
Perhaps you could put up a post with headline in bold to effect of "For Land Registry rep please" and they should come on and answer you on Monday I would think.0
