ES Parking Enforcement - Warrington

I have been caught in Warrington by ES Parking Enforcement . Car park was £2.20 a day and went up to £2.50 but there were no signs advising of this change. I replied back to them (without any contact details) saying that I owe them 30p and would not be paying £40 or £100. They have now traced me through the DVLA and have sent a letter asking for payment or they 'could' take County Court action or refer it to a debt collection agency even though they haven't supplied any timescales for this. I have read the sticky notes and intend to appeal again.

So, as I have already appealed this, albeit without contact details, and said that if they don't uphold the appeal to refer it to POPLA they seem to have ignored my request and just sent a NTK letter. They are members of the IPC, but it's not clear whether I can appeal to POPLA or if this is only for members of certain bodies and if them ignoring my request to refer to POPLA and provide me with a POPLA reference number will help me?

Has anyone had dealings with ES Parking Enforcement, and if so, how did you proceed and get on?

    if ES is IPC then you wont get a popla code, as that is for BPA members

    you can try an IAS appeal to the IAS appeals body for the IPC (but its a kangaroo court)

    read the NEWBIES sticky thread, tells you about all this

    so forget about popla , its not relevant

    I have received the NTK from ES Parking Enforcement and have read a number of posts saying that the NTK will be received between day 29 and day 56. I received it on day 76 after the ticket was put on the windscreen. Does this have any relevance at all? I read through the newbie thread and other posts but can't see anything that mentions NTK's received outside this date.

    Just wondering if it's another point I can mention in my letter to them?

    I don't think we've seen an ES NtK on here.

    Would you mind letting have sight of your redacted NtK please? A photo or a scan of it. Make sure you redact all personal information.

    If you wanted to you could use it as your only appeal point. The NTK does not comply with POFA 2012 so only the driver is liable, not the keeper. As long as you don't reveal who was driving they can do nowt.

    I note that there is no timetables quoted for a reply? I thought under POFA 2012 Section 9.2.(f), they had to state that the keeper has 28 days to reply to them. They haven't given me any timescales!

    @OP. Thanks for the uploads. They are using a pretty standard IPC template. IPC operators are increasingly avoiding PoFA 2012 and not pursuing the keeper per se, as per the Act.

    They are working on the basis that the 'reasonable assumption' is that the keeper was the driver, and the timescales for keeper liability are not in play. So 76 days is not a card you can use.

    You're at a stage now of just seeing what their next move is, you're highly unlikely to get an agreement to appeal to the IAS - not that it would have made any difference, they are reported as rejecting 80% of appeals, so you'd have little chance.

    See what happens next.
