Ebay what to do???

I sold my Samsung mobile phone on Ebay at the end of May. It's not often I would state this but the phone was in excellent condition and sold with loads of extras including 2 batteries. I have just received an email from a bit of a snotty guy saying the casing is cracked and the battery is puffy. He has included photos of the cracked casing. I know without doubt it wasn't cracked. I put a rubber cover on the first day I buy it to protect it and I'm adamant bout this. The thing that worries me most is the eBay email saying I'm to offer full or partial refund and he still keeps the handset!!! Shall I just request him to post it back? I've sent him a v. nice email to ask him to explain the battery fault but his manner wasn't v. Nice. I'm so upset by this but know ebay always takes the buyers side.

I would just ask him to send it back, and once you have checked the serial number and security markings, you will refund him.
Could it have been damaged in the post, or do you think he is pulling a fast one?Should've = Should HAVE (not 'of')

I know without doubt the condition it was in and I was using it right up to the date that I posted it. This is why I'm frustrated. I think il lose out though coz I've scrolled down my messages and he first messaged me bout a week ago but I was in lakes and my reception was terrible so I've missed it.0

TBH I can understand why he got a it snotty if you didn't reply to him message for a week.
As others have said, the only thing you can do here is ask him to return it for a full refund.
Did you take a note of the IMEI number etc, before you sent the phone?0 -
I know. I was in the lakes and had a right job getting reception there. I've sent him a massive apology and asked him to return it for a full refund. I'm not interested in an argument bout the phone just want it returned now.0

I've said it before and I'll say it again, avoid Ebay at all costs for selling anything electrical and anything over around twenty quid! Phones in particular seem to attract all manner of chancers. If you must sell anything like that, make it cash on collection after they've checked it thoroughly.
I know there will be those who say they've sold phones etc on ebay without problem but it seems to me that such items do attract more problems than any other.

It is because if you sell a phone, get your money and there is no problems then you generally don't go on a forum to tell anyone about it. If there is a problem then you will. It is the same for couriers. Find me a courier that has more positive reviews than negative. You are unlikely to write a review every time you send a parcel and it gets there with no problems However if there is a problem then you are more likely to write a review.0 -

Recommending cash on collection shows that perhaps you are unused to ebay rules , and as such might not be aware of the safety issues. Can I suggest that sellers considering cash on collection actually read the sticky thread about the issues of cash on collection. - basically though no seller can insist on Cash and need to be aware of the problems they face if trying to sell that way. I've always sold my phones on Ebay and never had a bit of bother out of all my phones this was in the best condition I've ever had, pristine. That's why it sticks in my throat a bit that I'm apologising profusely to him. He's asking to keep the phone and have some money refunded. There's something not right. I've asked for the phone to be returned instead . I just feel like I havnt a leg to stand on.0

You basically don't have a leg to stand on, you can either refund in full on return of the phone with you paying the return P&P or give them a partial refund (something I would advise against doing)
The problem is that its now easier than ever for an unscrupulous buyer take advantage of a novice seller, especially on high value items such as phones. This sounds like a carbon copy of this thread, see here:

For future reference for something expensive I would only ever use Gumtree, cash on collection. Selling something small like a phone on eBay but insisting on cash won't end well, I think you can have your listings pulled as you HAVE to accept PayPal.
You don't know for sure the Phone hasn't been damaged in the post but it must have taken one hell of a beating to damage the battery. I would offer a full refund on return and see what comes back but it sounds like they're just looking for money off. The suggestion of a partial refund from a buyer early on would make me suspicious.0 -
Yup that's what I've said. He said he's not back in London till next week to post it back so what about a partial refund?????? What's that all about.
I've stuck to my guns and said no please send it back as I don't want him to have a faulty handset and next week is fine. I sent him 2 batteries both working perfectly. He's Def damaged the casing himself and I just want to see what state my phones in now. I was a day late responding to him because of missing the emails and ebay says he can keep the phone with FULL refund so I want the phone back before he realises this.0
