Parking Eye Blunder Again!!

Hi All,


I have a Parking Eye PCN, same as in the "Parking Eye Overstay" thread but decided to start a new thread as the details of my Case is slightly different.


I am renting a room in Abbotsmead Place, Cavasham, Reading, RG4 8BB.


For those that know the area, there is a big Car Park with Waitrose, a Gym and an Iceland that all share this big car park with three entrances and exits. Yes there are three of them, the last one is at the back of the car park that leads directly in to Abbotsmead Place. It is mostly used for Service Vehicles only but can also be used by motorist that want to get Abbotsmead Place road which is a close. There is another road called Wolsy road that also leads to Abbotsmead Place.


I have always preferred to simply use the carpark as a shortcut to Abbotsmead Place road and vice versa both in the evenings when I am coming back from work and early mornings at about 8ish when going to work.


Recently, I was issues with two PCN from Parking Eye contending that I was parked in their car park over night because their cameras logged my as coming in to the carpark and then leaving in the morning. They sent me pictures of my Car coming in to the Carpark and then leaving the car park the next day.


The issue is, I was never parked in the car park and only used it as an access point to Abbotsmead Place which their rear camera on the Service Vehicle Entrance should have picked up. Parking Eye has simply chosen not to send me those pictures as it would have clearly shown me as leaving the car park on to Abbotsmead Place which is out of the carpark within 20 seconds of my entry in the car park from the front entrance.


I have sent an appeal in this morning contesting it but wanted to read what others have to say about it incase they turn down my appeal by sending a standard rejection letter which seems to be their modis operandi from reading on the forums.


All suggestions are welcomed.

    In my opinion this was not a blunder, it was a deliberate and well known ploy.

    This is a classic case of double dipping. Parking eye will conveniently have no record of your car leaving the car park after 20s and reject your appeal.

    So, you need to read up on how to win this at PoPLA using the double dipping as ONE appeal point plus poor signage, no standing, no GPEOL etcetera. Take general pictures of the entrance and exits, and specific pictures of signs especially ones high up on poles or walls, obscured by trees, small font, not compliant with the BPA CoP.

    well now you know thats not a good idea as it is private land.
    Unless you have a right of access to Abbotsmead Place via the car park they are going to keep sending you invoices for parking.

    You have three choices.
    Choice 1 pay up
    Choice 2 appeal to POPLA
    Choice 3 await court papers and see if the judge agrees with them or you, but bewarned Judges are very smitten with parking eye and have made some judgement that have thrown hundreds of years of contract and case law straight in the bin.
    I do Contracts, all day every day.

    Pretty dumb conclusion, considering that it would be fairly easy to prove or convince a judge that the car was not parked for the time alleged. The matter of trespassing over someone else's private property is an entirely separate matter that the landowners could pursue if they wanted.

    Quite obviously there is a right of access. If there wasn't there wouldn't be an entrance/exit to it. :)

    I would hazard a guess that the PE camera system only has a resolution in minutes rather than seconds ... so the fact you enter/exit in less than a minute means the system doesn't resolve both events and link them.

    There's presumably some number of POPLA wins before you get your car whitelisted (i.e. they'll ignore it). You should go the usual route, and ask them to whitelist as you'll appeal (and win) them all.

    Also complain to the BPA and DVLA about their abuse.

    Thanks for all your input in this case. Well, I spent a lot of time on line reading lots of good information on the way forward.

    I decided to lodge an appeal to PE and also Write a Complaint Letter to Waitrose Super Market in Caversham.

    I should get an update in a weeks time and then take it from there.

    I will fight this to the courts no matter how long it takes.

    I was not parked in the Car Park so why will I let these cowboys beat me down. That is not going to happen.

    Will surely update this thread with my progress and thanks every one for all your input.

    Ive had 12+ from UKCPM and they havent whitelisted me yet.
