Adrian means that they need not have braked so hard that the car spun out of control, simply because of a sudden loss of a rear tyre,.

Agreed, most people react to anything that suddenly happens by trying to brake their way out of trouble, which usually works on a "modern" car, due to all the three letter anacronyms that are fitted, but doesn't when the tyres have no grip (hence the massive number of accidents as soon as it is frosty)

Hi, they didn't say I was to blame they just said it would be classed automatically as at fault. thank you

I can't agree with you on that.

Whilst all of the 'key-board warriors' will not have been on advanced driving courses or taken IAM tests, those of us who have had it well emphasised by instructors (especially on skid-pans) that the way out of trouble is usually found by steering and not braking.

A blow out produces similar conditions to understeer or oversteer, and I have to agree that many folks will instinctively brake hard and make matters much worse.

The OP's spinning around was almost certainly caused by braking, and not by the blow-out.

The correct action would have been to apply gentle braking and hence gradually stop the weaving that the OP reported.

But of course it's all over in split seconds, and the vast majority of drivers just don't have the experience or training for such infrequent situations.

There is no need to berate the OP at all - but it's a good advert for the need for taking a defensive/advanced driving course

And when did you last get onto a skidpan to practice?

I'm a bit surprised at ops attitude though, she caused the accident, and that it was, an accident fair enough, but op was the cause and the result was a third party was injured - yet ops only concern seems to be worry about her own NCB and wondering if there's a way she can claim instead

That's very rude of you. I have been in touch with the lady and cannot apologies enough and I have even sent flowers. She is fine, but yes is going to claim whiplash. Police and witnessess were worried that she didn't stop in time and they said from skid marks they think she was speeding as so many previous vehicles managed to stop. Like I say the main thing is that everyone is ok!

Sounds like she could have been stationary when struck.

Possibly, quite possible that the car that struck her only saw her vehicle when a vehicle in front of them swerved out the way, with the OP's vehicle then coming into view.

Much would depend on how long her car had been sat there and what evidence exists that suggests the other vehicle just drove into it when it was clearly visible for some time beforehand.

Speculation on my behalf of course, but in my day job opinion, it doesn't sound promising for the OP.

One can only speculate when drip fed information.

Didn't any of the witnesses see her driving to give an opinion on speed?

Bit of a silly comment for the police to make, if there is physical evidence either investigate it or keep your opinion to yourself.

I was on the M6 two weeks ago and there was a three car crash just ahead. The Traffic Wombles had just arrived and held us back (I was 4 cars in). They moved the three cars quickly and then let all the traffic carry on but never bothered to move any of the broken glass.

This annoyed me. I would rather be delayed for another two minutes while they got their brushes out.

You're still in the lap of the gods when it happens. I've seen several with greater training that you've had crash and and equal number get away with it.
