child has his personal injury case listed for county court?

    what happens if they know they were in the wrong and they don't turn up or want to go to court?
  • If they don't show then their case is considerably weaker. Odds are the claim will never see the inside of a court room though

    but if the defendants knew there only witness did,nt want to give evidence because they told a wee white lie by saying it was only a tip,would they even bother listing it for court,nevermind waiting until the morning off the court?

    The whole point of the court case is to decide if the defendant is the 'person in the wrong' or not ...

    Not necessarily, and probably not in this case.


    The court case may have come about because both sides cannot agree on the level of compensation due to the injured child
  • what was the outcome of this?
    me and my family were in a car accident,through no fault of our own..we have a court date for our children,but nothing yet for me or hubby.
    will the insurance/other sides insurance try and settle all the cases on the day of the childrens court date?
    would it be in the insurance companys interests to get all done and dusted?

    Put these questions to your solicitor.


    There are many variables involved which only your solicitor will know.
  • The odds are the purpose of your court hearing for the kids claims is to get the settlement awards "approved" by the court, so the monies then get tucked away in a court bank account until the kids turn 18.

    This is standard procedure with infant claims under Part 21 of Civil Procedure Rules, but as Quentin says, these queries are best directed at your acting solicitors who will know why this is happening and will be best placed to advise.
  • I understand that..my solicitor is off on leave.i had put it to the back of my head until I seen this tread.i just wish they would settle and get it over and done with.whatever the children get it will help toward Uni..
    would it not be in there interest regarding costs to give a figure for all the family and finish it at that?case closed.....

    You ought to only want the case closing when it is in all your best interests!


    With children being involved then most solicitors would want their cases dealt with by the court.


    But surely this has been going on so long you can await your solicitor's return from hols. to get accurate answers to your questions?
