child has his personal injury case listed for county court?

    what do they mean when they say it was a lvi accident?do they mean your getting very little compensation or no compensation at all?
    Would it not make more sence for both sides to agree a figure and they both get there fees and move on to the next case.
  • LVI = Low Velocity Impact = the speed of the collision would not have been sufficient to have caused the occupants of the vehicle injury.

    so if a solicitor is appointed to defend the case and then LVI is thrown in too,the defence have to fight it tooth and nail to the bitter end?
    and they then want to pay an engineer to say there was a crash,but it might not of been that bad.....
    why do they not just pay the child the compensation due instead of putting more cost on and dragging it out?

    They are entitled to put in a defence.


    But you may be getting concerned unnecessarily


    As posted in #11 this may just be a negotiating tactic and won't end up in court.


    Neither side will really want to go there!

    I guess a couple I hit claimed compensation from our 5-10mph bump -_-"
    I initially asked for a quote to see if we could do it without insurers & they gave a Merc quote of 1200 including labour (the other thread demonstrates how weak the body of mercs are). As it was a hire car (those borrow for n years deals) they couldn't use a normal garage.
    A year later when I'm renewing my car insurance it says a claim of £3800-4800 was done!
    I hate the people in this world

    edit: not saying this is what happened here, just ranting

    the childs car accident was more than 5mph!! I suppose when there was £1200 worth of damage there must of been a "bump".
    did you not notify your insurers and let then look at the cars?

    Looks to me that they are trying to say that collision was such that the injuries claimed are not likely to have happened as a result of the collision.


    As long as you have good medical evidence to support the childs claim then there should be no problem.
  • Insurers try this all too often, it is often fueled by their policyholder saying "I barely touched them". Sometimes this is genuine, other times it is the other party just trying to down-play the severity of matters.

    All too often, the insurers defend these claims and ultimately fail. This results either when the case goes to court and a judge finds in your favour, or if there is a belated attack of wisdom by the other side.

    The nature of the damage does matter, not just the cost of it. For example if I drove past your car in mine and scraped my wing mirror the entire length of your vehicle and took out your wing mirror, I bet I could cause £1200 of damage. it does not mean you would be injured though does it?

    Just be guided by your solicitors on this. I can only speak from experience that unless there is no damage or you are a bunch of reprobates that come across as dishonest and lacking in credibility, you will win the day or the other side will back down.

    if a personal injury case goes to court,does the defendant (person in the wrong) get a summons to attend the court to give evidence?
    if there trying to defend the case saying it was "only a tip",would the person who says it was only a tip have to give there version of events to the court?
