TV under 2 years develops fault- my rights?

    I didn't want to start a new thread! I ended up going with an independent report in the end which states the TV is beyond repair as the part is no longer supplied by Samsung.

    I'm waiting to hear back from Curry's now on the back of the report but want to know what the options are as they can't repair it. Are they likely to offer me a credit note and how is this normally calculated? (I'm assuming it would not be the full purchase amount as I have had nearly 2 years viewing without issue). Can I ask for a cash refund or do I have to accept a credit note? And should I be prepared to negotiate. If anyone has any ideas how these settlements are calculated I would be grateful.

    It doesn't sound like your report confirms that the fault is inherent. An inherent fault is one that was present at the time of sale but not necessarily apparent at that time.

    Your report appears to be confirming that the television is indeed faulty, but does it give any idea how the problem came about. For example, does it mention a manufacturing defect? Does it perhaps say the problem isn't due to misuse by the consumer?

    Without that, I fear that Currys' stance will not change.

    Like I warned in post 4 Currys can be very picky as to what they accept as report and if there is no mention of an inherent fault or manufacturing defect resulting in premature failure I'm afraid they may knock you back.

    If all goes well and they cant source parts you'll be offered a partial refund I would imagine no more than 3/4 of the purchase price in store vouchers but in all honesty I'd be very surprised if they didn't have the parts in stock.

    Had similar issues with a screen failure on a 3 year old set, like yours googling threw up a common fault of a screen failure. Paid the money, Currys collected the TV and returned it fixed a little over a week later. Money was refunded.

    Don't understand why you'd pay for a report rather than just let Currys sort it out for you. You've given them no chance to fix and I agree they might well be picky over your report.
    I fear that in attempt to save the £95 which in all likelihood would have been refunded anyway, you've cost yourself some cash.

    If the route you have gone doesn't work, contact Samsung and tell them that you are not happy about an expensive product which has malfunctioned within two years ,as you can reasonably expect it to have lasted much longer.

    You could do that, but Samsung have no obligation to do anything once any warranty has expired.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Not only does the report likely not meet SoGA criteria, Currys/Knowhow have Service Level Arrangement with suppliers where suppliers must continue to provide parts for X years after the TV was sold.

But if they don't have the part required I wanted to know where I go from there in my discussions with them.

    The report does not give any indication of the failed part and why . Failure due to age is not valid reason for a warranty claim . More than likely you may be offered a pro rata refund as cost of TV less 2 years usage .

    If the thing is inherently faulty, they must provide a remedy.

    That remedy could be a repair, replacement or refund.

    If a refund is decided upon, that that can be reduced to take account of the use you have had. There is no one formula for working out the reduction, and to get the best value you may need to use your negotiating skills.

    Just noticed this was for a Plasma.

    Samsung Plasma's are notoriously unreliable especially the later ones when extreme cost cutting kicked in. Lines are very common and in 99% of cases vertical lines can only be repaired with a replacement panel. I will be very surprised if they carry replacements in stock, if not they would be very hard and expensive to source from suppliers now. They might deem it beyond economical repair.

    I would brace for a partial refund, anything around the 3/4 purchase price I would bite their hand off. If they do repair it and return make sure you check it over, unpacking it and powering it on before the delivery drivers leave.
