    As the owners or website controllers didn't have any control over what day or time the OP chose to book the room, how can they be held accountable for this?

    It was the hotels policy to reduce the rate of their rooms after customers had booked a none refundable rate. Therefore the fact the OP may suffer a sleepless night due to the psychological effects of this pricing policy is obvious the hotels fault.

    I am sure Sir Lennie Henry would agree.

    Apart from the fact that you are advising someone to commit fraud (deciding to try to claim before even staying couldn't be anything other than fraud),
    They aren't deciding beforehand. Or if they were, the thought of getting done for fraud probably wouldn't lead to a good night's sleep anyway, and so no fraud in the end anyway ;)
    it wouldn't be a valid reason to claim anyway.

    They can control their prices, so if the OP doesn't sleep well because they're annoyed at paying too much, or worried about how they're going to eat next week because they've spent all their money on the hotel...

    I'm sure some people will take this post far too seriously.

    It looks like they released their sale rooms, hence the £39, which is lower than the normal Advance Purchase rate. It's unlikely they would drop that much otherwise.

    I do this pricing stuff, for a different chain, OP you were just unlucky and missed the sale.
