ADVICE NEEDED! Concert tickets

Bit of a long winded one:
I bought some gig tickets and about 10 days before I realised I had not received any tickets. So I got onto the seller and they apologised, said they had not been sent out but would now be by Securedelivery.
2 days before the event they still have not arrived, emailed again to ask the procedure if I had not received them by the time of the gig. They assured me they would invalidate my tickets and have a set at the box office for collection prior to the concert.
Physical tickets arrive but are promptly binned as invalid, arrive at the gig to find no tickets!! No name, no tickets, no correspondence from AXS ( the ticket vendor). Would not accept my email correspondence as proof of purchase so missed the gig.
What are my rights now? I have contacted AXS but predictably am being ignored. Have they breached their contract? Am I entitled to a refund as I believe it is their fault from start to finish?

Oh my word - why would you put concert tickets in the bin - even if you thought they were invalid and you were picking up copies. There is absolutely no way I would have put them in the bin and travelled to the gig without them. I would say that you received the tickets and so have no rights to a refund.0

I agree. Even if they were invalidated you would have lost nothing by taking them with you and explaining the situation.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
has to be a wind up...doesnt it.
tickets arrive and are binned then travel to concert without tickets.
I know what was said but, taking the tickets with you would have cost nothing and you could have binned them at the venue once you had replacements, or not as it turned out0 -

Contact your bank explaining the above -
i) if you used a debit card you can pursue a debit card chargeback for "Goods/Services not delivered" within 120 days from purchase.
ii) if you used a credit card you can pursue a refund under Section 75
Provide your bank with the correspondence you have had with the retailer (ie the emails you have recently sent them)
You should easily get your money back.0 -

I did read it in detail and the tickets were delivered, The suppler promised to provide new ones if they didn't arrive but they did arrive so which service wasn't delivered

Look at this sentence from OP:

The wording strongly implies that the tickets arrived before the gig started.
Look at this sentence from OP:

This says that the invalidation happens if the tickets don't arrive "by the time of the gig" ie within a time frame which could ensure that OP can use them to go to the gig.
Therefore one can surmise that it is extremely likely that the services WERE delivered in time to negate the invalidation procedure, and also that OP chose to bin the tickets as opposed to using them to gain entry to the gig. Consumers are perfectly entitled to purchase an item and then immediately bin it upon delivery if they so choose! Doesn't necessarily mean that a company is liable.
Maybe you should quote the OP (and explain any extrapolation you make) if you wish to argue a "services not delivered" stance, because most people won't see it like that here...
P.s. It would be unfortunate if the company didn't have tracking information for the delivery. That might bite them in the bum (and also provide the OP with an alternative stance to base their argument on).0 -

The retailer advised that the tickets had been invalidated. Common sense dictates that the OP probably should have taken the tickets just in case, but 'just in case' doesn't factor into this particular situation as the OP had specifically been advised that the tickets he had been sent had now been invalidated.0
