dilemma......selling a cat c car to gararge where bought it, not informed of cat c
                    hiya,
a year ago, hubby bought a car from a local garage, all was well, and was told nothing wrong with it, all checks are sound etc......
2 weeks ago we tryed to sell the car, as hubby got his mobility car come throu after pips messed up his claim..
we had a potential buyer for car, but buyer contacted us and said the hpi checks says car is a cat c car. now we was not informed of this when we paid for the car.
The other day we went back to the garage where we got the car and told the man whom sold it to us, he was utter shocked as he sold the car on behalf of his friend, and he didnot know and you could tell he was telling the truth about not knowing about it being a cat c car!.
we payed for the hpi check online, and it came bad as having a marker on the car, and was told it will be removed.
Now man at garage said to bring car back to him, which we have planned to do tomorrow, and he said he will sell us the car and get us some money fror car.... but, what im worried about is...
ashould i make a contract or letter and get him to sign it to say we have gave you the car to sell on our behalf, or how is the best way to word it please.
any advice would be great, thanks

            hubby and the man spoke the other day and they agreed, that the man will get us anything over 800.00 for the car, just thinking of making him sign a contract letter to prove we have gave him the car to sell for us, otherwise he could turn around and say you never gave me the car to sell. iycwimIm now a mum of 4 children. but dont know how to change my username.lol0

            Look on the VC5 (log book)
 It will say on there if it has been Declared cat C or had a VIC check (dateXXX)I do Contracts, all day every day.0

            finally got the log book after months of asking for it, had not checked, but will check now and all it says is.........
 declared new at first registration.
 non transferable registraction mark
 substantually repaired and/or accident damaged, identy, checked on 3/3/11..

 They must tell you if its a Cat C write off.I do Contracts, all day every day.0

            You need to find out exactly what kinda deal this garage man is offering. Will he take a percentage, fixed fee or what?0

            yes bought it from from a small car dealer, has his own garage n forecout with cars for sale.
 all he said was bring car to him tomorrow and he will sell it on our behalf and make sure he gets a good price. how can i word it on paper stating hes selling xar fir us n to get him to sign aswell, as proof . just to safegaurd us reallyIm now a mum of 4 children. but dont know how to change my username.lol0

            I have a better idea, I would tell him as he has sold you a write off and not disclosed it.
 He gives you your money back and you wont sue him in court.
 That sounds like a better idea.
 If it has not been declared to your insurance they are most likely to cancel your insurance if they get wond and that will leave you paying more on insurance for six years.I do Contracts, all day every day.0
