    It doesn't matter what the distraction is, or even if there was one. Careless driving is the standard of driving.

    The actual device is only an issue if it is hand-held.

    It's not a very difficult concept, unless you're actively trying to muddy the waters for some reason.

    And until you fail to notice any of that then the offence hasn't taken place.

    And it's too late because you've caused an accident. Laws are there to prevent accidents, not just punish people after they have occurred.

    Having had an accident you could be prosecuted for careless but until you move off there is no evidence to prosecute. Unless the same applies to turning up the radio or heating.

    Exectly, but until you've had the accident there is no evidence of an offence.

    So you're mostly agreeing with me, in an argumentative way? Fair enough.

    If you think you'll be fine if you just happen to get away with it, then also fair enough.

    My recommendation here is to not risk it. It's just not safe.

    I'd find it hard to believe that there would be no evidence. Eye witness statements or camera footage?

    What I'm saying is the mere act of touching a tablet that is fitted in a way as not to be handheld isn't an offence.

    If you want to prosecute for any offence you'd require evidence covering the necessary points to prove.

    You're just shouting due care without any thought as to why it is or isn't.

    Not so sure about that...

    You're in a stripy Volvo, sat at the lights. The guy in front is mucking about with his fondleslab, securely held in a cradle on the dash. The lights turn green. He's too engrossed in reading his email to notice. Eventually, he notices, and wellies it away, narrowly missing the car coming from the other direction who's taken the opportunity to turn right, across his path.

    Do you put the lights on and invite him to spend some time at the roadside in your company?
    Has there been an accident? No.
    Is he driving carelessly? Well, you tell me. It could easily be viewed as dangerous, but a £100/3pt FPN for careless, and a roadside bollocking, would sound to be the right result to me.
