Except the OP didn't use the 3 minutes to read the sign!

"they" also read this forum , so will already have screenshots etc of the details posted on here

some people must think this is like a confessional where only 2 people participate and the walls dont have ears ;)

its actually a public forum where anyone can read the posts, no matter WHO they are , plus its regular reading for private parking companies

yet the amount of personal info posted by people is unbelievable despite the warnings about it, not only here but on social media in general

But the stats don't back up the proposition that Napier regularly 'do court'.

    http://parking-prankster.blogspot.co.uk/2015/03/court-cases-2014-2014.html#comment-form

And search on 'Napier' once you've opened the following link:

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

DON'T PAY HOPING TO GET AWAY WITH PAYING IT LATE. THEY WILL STILL SUE YOU. NEVER PARK THERE - YOU'VE CHOSEN ONE OF THE WORST CAR PARKS IN THE UK FOR FAKE PCNs.
Really??? Are they known for this then? Its horrible because its a local park that is paid for via council tax and this is just another tax!

I have to pay £80 rather than £40 because I appealed, to me this seems a contravention of my rights- I have the right of appeal and should not be penalised for doing so, win or lose!
Yes they are known for it, yes Willen Lakes is a horrible cash cow for them, yes they watch people walk away then pounce in minutes. Yes they will sue you now you've lost at POPLA - if it makes you feel better, I wrote a POPLA appeal for someone on here re Willen Lakes and it still lost, because they made out they'd spent £2000 on legal advice and that happened to 'balance the books' re the GPEOL sum and the POPLA Assessor swallowed it. She was a disabled lady as well, and she had to pay them £80. De Savary should be ashamed IMHO, fancy making money like this.

And I didn't mean the difference between £80 and £40 being 'out of time' to pay - of course it's not £40 any more (discounts on any parking tickets are only early bribes, it was always £80). What I meant was, can you even still pay 'only' £80? How long did the letter give you to settle at £80 when it was sent over a month ago? You need to re-read it. No good paying £80 if in fact it's too late, so double check what it said.

Not worth defending on your own, no.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Do not be too hard on Mr de Savary, he has invested a lot in his business and in many cases, owns the land he charges people to park on.

My advice would be to pay up and try to avoid his car parks if you intend to bilk in future.
You never know how far you can go until you go too far.
  • Ive volunteered personal information because I was asked for it! Also I cant afford legal advice so this is the next best thing!

The letter says I can pay the £80 to avoid court so that is what I'm going to do. I will never visit Willen again and will advise everyone I know to do the same!
  • That's your call, but you would seem to stand a decent chance of fighting it, if you wanted to risk it.

    Hi

I just received a notification that Ive lost my appeal and now have to pay £80! (rather than the £40 if I hadn't appealed - how is this legal)?

Basically earlier in the year I parked at a local park to drop off my sons inhaler, I was gone for 2-3 minutes, less time than it would to walk to the pay machine.

As I walked back down the stairs I saw the attendant, I called out to him but he ignored me!

I appealed on the basis of time parked, it would have been longer if I was queuing at machine, I could've been getting change

    - its a local park largely paid for by council tax and over zealous charging is uncalled for. Yes i realise now that mitigation doesn't work but is there anything I can do?? I'm so angry about this, its very unfair.

I did contact the park owners but they simply past my comments on to the carpark operator and didn't even acknowledge me!

    Help, advice would be great!

    Thanks.

you were not asked to fill us in with all those details above (quoted from post #1), where post #1 is the first post in the first thread , you gave those details freely in that opening thread in the opening post, nobody here asked you for an explanation as we dont need the info, but the parking company will be rubbing their hands with glee in getting it from the horses mouth

I believe you posted a second thread and didnt give any details or a link to the first thread, hence the confusion and asking for more details (which your second thread didnt have)

but the 2 threads contain far too much detail about "what happened on the day" , but we dont want or need to know about "what happened on the day"

people like yourself feel like you have to explain it, as if an explanation justifies the events, but the parking company beg to differ and our point here is that you didnt read the signs, decide not to park, and leave, you parked up and didnt pay as you were running a quick mercy errand and got caught out

but by saying so in this thread you could easily have handed it on a plate to Napier, in writing ( rather than a "no comment" )

but as you say, if you dont want the hassle, pay up, learn the lesson and move on

then , if you get any more parking tickets, dont try to "get it off your chest" with some long winded "explanation", in writing, on the net

just state the case in brief terms, what the pcn says and the general location (like in england, or wales , or milton keynes)

then the next stage can be decided upon
  • Ok thanks for your explanation and thanks everyone for advice. I think the attitude of some people is a little preachy and unfriendly - I wont be back.

I note all that has been said but I didn't know that when asked for location I needed to be vague and when asked for the reason behind the ticket I needed to be vague also and therefore I feel there is no need to talk down to me and make me feel stupid.

I have nothing to hide anyway because the explanation I have given here was the same one given to Napier Parking and therefore if they have/do read this then they will not discover any new information except that I am being made to feel like a fool by people who are old enough to know better.

    this isnt the Samaritans

when dealing with a serious topic like possible court cases and the law, things need to be said in black and white , feelings dont come into it

if you need to be told where you went wrong, then its better to do so even if it makes you feel small or belittled , its free advice and given with the aim of getting the correct info across

personally, I wont give out platitudes or hold somebodys hand, we are adults here and an adult in the wrong or who is ignorant of a situation should be strong enough to accept the criticisms and to accept they have shortcomings (we all do) , that way they learn so that it doesnt happen in future

my full and frank explanations were in response to your denials whereby you hadnt been aware of what you had written, or the implications of what was written

sometimes, less is more, it certainly was in this case

the intention is to educate you in where you were wrong, not to hurt your feelings, but sometimes the latter is a consequence of the former

I only hope that whatever you do in the future, you have learned a lot from this as the next time it will be a retail park, or hospital car park , or a supermarket , or some other venue (this is what I have now learned over the last 2 years from reading stuff on here, ie:- better educated on this topic than I was 2 years ago)
