Appealing a DWP Decision for PIP. Advice Needed!

Hello all, I'm new here and this is my first post as I would really appreciate some help. I placed a claim for PIP (formally DLA) and was sent for a medical with ATOS..after this my claim was turned down, so I asked for a reconsideration, this has also been turned down..so now I have the right to appeal to an independent tribunal.
Has anyone here ever appealed to an independent tribunal against the DWP? Any advice on filling in the form, what I should write, evidence to enclose? Anything at all that would give me at least a chance of the decision being made in my favour. I will say that I made the claim for mental health related problems, and this is causing me a huge amount of stress and anxiety because I barely have enough money to live on at the moment. Please, could anyone help me with this? Thanks in advance for any advice given.

    I would strongly advise you to get some help from CAB (choose one with a benefits specialist) or a welfare advisor - list of contacts within above link.

    I would suggest you submit a letter with your appeal addressing each of the headings and explain why you think the points awarded by DWP are wrong and what points you think you should get. It is far more helpful for a Tribunal to understand what parts you are disputing rather than a long letter about your condition and life.

    You need to keep it relevant and to the point based on the criteria.

    It isn't about your condition, but how it affects your daily life.

    Also remember that each activity has to be done to a reasonable standard, safely, reliably and repeatedly, so if you can't do it in that way then you should state that.

    UUmm yes I know how you feel. For a start PIP payments are not purely as a means to get more money to live on unless you are having to incur extra costs that your mental health condition causes.
    I am as much mystified as you seem to be as to how some people breeze through the PIP application and get an award, sometimes without an assessment. In my own case I had DLA Middle rate care for mental health problems and High mobility for physical problems. I had that award for 19 years. I had to apply for PIP last year and after the assessment I was told that I didn't qualify for one single point. I gave up as I do not have the ability, strength and mental capacity to take on the DWP in a court of law.

    This is, as you have been informed repeatedly, on many aliases, absolutely not the case.
    PIP or DLA are not specifically granted to pay for any cost, or group of costs.
    Being unable to cook does not mean you are required to spend the funds on food.
    Being unable to mobilise does not mean you have to spend that money on mobilisation.
    Being unable to socialise does not mean that you have to spend that money on an internet connection to post annoying messages.

    OK, if that is the case and the money can be used for anything and everything, why does everybody jump up and down when I say that not everybody has extra costs due to their disability. I get post after post saying that they have extra costs.
    So for those that do have extra costs, should it be expected that those costs are met from the DLA/PIP payment - ie linked to them?

    Nowhere in the dla/pip form does it ask you what your extra costs are. Even on .GOV.UK it says money can be spent how you like. Nobody audits it.
  • Get in touch with the citizens advise they will give you specific wording that you need to use which is relevant to your case. They are invaluable

    So it's basically a tiered amount of income given based on how many boxes you tick. It's often never spent on anything in certain areas of mental health.

    All great paying for transport or services IF you can use them. If you can't go out alone or at all it's as much use as a sieve for swimming.

    So if it can't be spent in that way - why would anybody want to claim it?
    Surely it is a payment to allow for 'the extra costs that the disability brings with it'?
