    Just kick the gardener out. He'll either

    * get the message and go back to his employer for instructions (and you'll have written to the LL of course)
    * or continue to bill his employer for doing no work - not your problem.

    Just ask him to leave each time he arrives? How is he getting access to the back garden? Why is he digging things up each time?

    What a very young, educated, middle class attitude!

    The gardener may vist 30 gardens a week. He may not be well off or well educated with technology. My gardener has neither mobile phone or can text with anyone else's.

    He may not know he is coming to your house until that day as it will depend on the current weather, the weather over the past few days and what else he has on.

    You are looking at this from your very one side lifestyle, he probably doesn't live the same life as you.

    Either cancel the gardener completely and do the garden or put up with it!

    Can you not make an arrangement with him for a particular morning or afternoon each week or fortnight? If he just turns up at random times then this is rather unprofessional, there is no harm asking. You don't need to know an actual time but "every other Wed morning" sort of thing seems quite reasonable.

    When I have seen him we have spoken he's a very pleasant chap and has expressed his surprise that I didn't know he was coming.

    I have asked him to come back at more convenient times when it hasn't been convenient for him to be there.

    He is able to just walk in the back gate. a brief explanation of the layout - front garden is on the road (i accept I can't stop people going in it, but its not nice coming home to find some has been in there digging it up) the rear garden is though a shared access gate (private for myself, upstairs and the unrelated property behind us) accross the parking spaces and onto my garden.

    The front has gardeners garter which I know can be unruly if not kept under control, yesterday he had been round whilst I was at work and ripped half of it up and stacked the rubbish bags against my wall.

    It was the gardeners offer/suggestion to send a text to me, as we agreed that he couldn't always know when he was coming due to the weather etc.

    I don't think I am being unreasonable in asking for a text or call to say I was hoping to come round to do the garden today is that convenient?

    I always do my best to accommodate and as long as I know about it there is no problem.

    Arrived home yesterday to half my garden ripped up

    Tell the LA and LL their gardener has vandalised your garden.

    My only concern for you, would be come check out time and the LL views the condition of the gardens, would it be the same as when you arrived? Does the LL know what the gardener is doing? Does he remove the cuttings and waste when he has finished? I think you are lucky to have someone doing the garden, its also a bit of security knowing someone is "around".

    I would just try and tame him and get an informal arrangement, see what he says.

    But its worth someone on here giving their opinion, you don't want a "Where has my lawn gone?!" type of thing coming from the LL on check out or inspection.

    Get copies of the keys and give them to upstairs and the property behind. Explain it's for increased security to stop unauthorised people coming in.

    20 posts with lots of ideas/suggestions. Not sure why this is so hard. Just pick up one or more of the ideas and get on with it!

    You say you live in a flat, is the garden yours only or do the other flats have use of it too?
