Estate Agent refusing to pay Judgement costs to me

    Don't muck about just send in the baliffs, I have sent them in before for something a bit different but a company nonetheless. If anything it gives them a kick up the !!!!! and a horrible fright especially if they have customers or clients around. At the moment they probably think you will just go away.

    OP would need to go to the High Court for this, which would cost more money (which could be recovered from the EA in question??).

    Yes it could be recovered from the letting agent...if they have the money.

    Thanks for your advice.

    The judgement is against the company, 'The Market Homes'.

    I have aswell gone through the Property Redress Scheme which they are apart of. I am waiting for a decision from the ombudsman but the initial feedback is they will need to pay it or be removed.

    Without going into details, my case is pretty much a certain to call it. There is no way they could argue their case.

    I don't really know how to put this, but this company is really dodgy anyway. They haven't responded to anything. I wouldn't be surprised if they don't even know what's happening. Barely anyone can speak decent English and I doubt would know the consequences of these actions.

    All the advice out there is aimed at suing people rather companies, so they talk about taking money from their pay, etc.

    I wish someone would just assess the situation, look at the company income and realize they can pay this and they must.

    So, per advice above, go back to court and ask them to enforce the judgement with bailiffs.
    You and a couple of blokes turning up to clear out their offices (potentially while they have customers around) may will focus their minds a bit.

    Take a look here and see how the last financial year did it may not prove nothing but if it shows a healthy balance then may be worth while pursuing as per above posts.

    You probably will not get much out of the bailiffs. They might be able to take away a printer, a computer, a couple of desks. It will be hard for them to get 5k of assets, especially if the guy claims it's all rented.


    Sheriffs is an option, but it will cost you and whilst they seem to be much more effective than bailiffs again there is no guarantee you'll get the money back.


    Having said that, there might be quite a lot of satisfaction in getting them 'visited' by such officials.


    Other potential options are a charging order if they own their office or other premises - unlikely, but will only cost you a couple of quid at the land registry to find out.


    The thing I would consider trying before bailiffs is a third party debt order. Presumably you know the bank details that they ask people to pay money into. You may be able to freeze it.

    might be worth an embarrasing tweet, or facebook post? Keep it clean, factful, polite.

    First call is to contct the EA's regulatory body, and/or local chamber of commerce.. I think they would take a dim view of members not paying their debt.

    Indeed:
    If the Ombudsman upholds your complaint, he may make an award to you ranging from an apology, explanation to reimbursement of financial loss or a compensation sum for inconvenience and distress. The Ombudsman can make awards up to £25,000. Any compensation payment will be calculated based on demonstrable loss or costs and will take into account any degree to which the complainant has contributed to the failure or loss suffered.
    And if they are removed from the scheme they would be trading illegally since all letting agents must belong to one of the 3 schemes. I doubt they could join the other two....
