Student FInance Refusal

Some one from Student Forum refered me here. They said there was someone by name of Taiko and many other people who would have more knowledge on my circumstance.
Am a parent to a 18year old daughter who is due to join uni in September.
We applied for SFL but we have been turned down on conditions being, that she has not satisfied 3years continuous ordinary residence in UK.
My daughter was in a boarding school abroad in the year 2012. During the one year, she would come home (UK)during school holiday. As this was her home.
When we applied for student finance, they did request for additional information, wanting to know where she was in 1st Sept 2012 to 7th Dec 2012. They asked for a letter from her boarding school to prove she was there. The boarding school wrote a letter confirming on the specified dates she was there as student and came back on home on 7th Dec. 2012.
Now the Student finance have replied and said she is not eligible as the information she has provided, she doesnt qualify.
Its so frustrating her home address was and still is the same address we are in the UK.
Can someone please advise
As the honest truth is, she was only in the boarding school for education and her home address was the UK.

I'm sure Taiko will sort you out, but I would thing that there has been some sort of misunderstanding at SFE and that they think the family home was outside of the UK. If you have evidence that the family was resident in the UK (council tax bills, pay slips with UK address, utility bills, etc.) I can't see that a child temporarily living elsewhere would make her a non-resident. Ok. Were there any other members of the family in Kenya at all, or did you all maintain UK residence in that period? I think I know the answer from your post, but I just want to clarify.0

Answer to your question is No
On opening day She would catch a flight from UK and went straight to school.And closing day, school would drop her to airport and she would come back home.
On a different note,having relations abroad, would it be an issue?0 -
Based on the information that you have posted up, I am in agreement with SFE's decision that she is ineligible on residency grounds at the moment.
Your daughter needs to defer her studies for a year in order to be eligible for financial support.0 -

UK was her home.

I did maintain all the residence on that period.
During school holidays she was an active member of a Surrey local teen/youth club that she used to attend.0 -
But during that remainder of the time, she was in Kenya. She wasn't in Kenya due to family, as you stayed here.
Schedule 1 of The Education (Student Support) Regulations 2011 is clear on the residency requirements, and there's no scope to override this. Your solution is deferral, as it is evident she has broken the 3 year residency requirement.0 -

The period in query is 1st Sep 12 to 7th Dec 12.
Do student finance do partial payment of the year.?
I suppose what am asking is, if we are able to pay for the first semester.(3000)And reapply in January 2015 for the remaining 2 semester is that possible?0
