  • I was under the impression the tax code changed for this year's allowance but we could apply for last years back dated and receive a refund for that. Which is what I was informed in my first phone call and I'm sure i read it in the information on here. But they just keep changing their story?

    Hello there,


    My father receives the state pension and pension credit but my mother does not. My mother does not work and is 61, can my parents apply for marriage tax allowance? My father's total pension/annuity income is around £11,000 a year, however my mother does not work and is not at pension age, can they still apply?

    it depends entirely on whether your father pays any tax in the first place?

    the tax free allowance for 17/18 is £11,500 so there is no point in your mother transferring some of her allowance to him if he does not pay tax to start with

    if he does pay tax then yes they can apply as explained in the guide which is linked off post #1 on the first page of this thread

    Hi All
    As a non tax payer for 2017/8 and not using my full allowance during 2016/7 I applied to transfer my tax free allowance to my husband on 6 April 2017. As I have not had confirmation it has been processed and my husband's tax code has not change nor has he received a cheque for 2016/7 I phone HMRC at the end of June to be told it had been approved but will take time to be processed probably by the end of August but my husband could try phoning to push it through? My husband does not like phoning these big organisations so had not contacted HMRC. Does anyone know how long HMRC take to confirm the change in tax code and refund previous year payments?

    HMRC timescales are slipping badly at present. You might like to log into the HMRC website where there should be a timeline for a response to outstanding matters.

    Not that I'd believe a word of what it says there :)

    New tax code for this year should have happened pretty much immediately but refund for 2016:17 will take longer (between June and October it says somewhere on gov.uk).

    You did apply twice though didn't you? As you applied on 6 April you would have to make two applications, one for 2016:17 and a separate one for 2017:18.

    If you apply after the tax year ends (2016:17 in your case) then the application for the previous year only applies for that one year.

    If you apply during a tax year (for that year) then the application is accepted for that year and subsequent years for ever (or until one of you cancels the application).

    It seems likely you have only applied once, for 2016:17, and any refund due to hubby for that year will go to him in next month or two but you probably need to make a separate application for this year (which will then continue year after year without you needing to apply again).

    Thank you.

    It's so confusing. I applied online and was given the option to apply for the current tax year and also to request refunds for the previous 2 tax years.

    Hubby has just checked his tax code and it is still showing as 115L so has not been changed and I'm not sure why it's taking so long.
  • So when you got the options which tax year(s) did you actually apply for?


    Given your apparent uncertainty about what you actually applied for I think you are probably best of phoning HMRC as tax code 115L definitely doesn't include Marriage Allowance (it would have M not L at the end of it) and is significantly less than the normal tax code of 1150L.
  • Try again. Last time I looked, a few months back, it was a bit confusing you can easily apply online now. I applied online a couple of weeks back (had to do it in my husbands name as he is the non-tax payer). Got a confirmation email that day and this morning a cheque for £428 through the post plus my changed tax code. Dead easy.
  • Hi guys, I am not eligible for the allowance this year but eligible in 2015/16 year according to that year's banding due to having lower wage. Can I back date and apply just for that year or is it possible to backdate only if eligible in current year? Thanks.
