  • Hello there. I used a 3rd party company to clame my tax back from hrmc. I got a letter from hrmc telling me they would be sending out a check for £730 to the 3rd party company. So far so good then I get an email from the company telling me the are taking £100 admin fee and 35% of the remaining amount. I am getting a check for £330. When I did the application there was no mention of the fees I would pay if I had of known they would take over half I would of just done tbe application myself on hrmc's website. I understand they would have to take some sort of fee but over half seems like daylight robbery. Is there anything I can do?

    Afraid not - unfortunately you are one of many who have the same experience. Check their website - the fees are visible, and while many will consider them extortionate, completely legal. Somewhere within the application you will have agreed to both the fees and the authorisation of this company to act as your agent and receive any repayment directly.

    Firstly anyone who applies for Marriage Allowance can only ever pay the same amount of tax or more.  They would never pay less tax and get a refund as a result of applying.

    So I presume you mean your spouse applied and you are receiving the benefit of her application?

    If so what did she sign up for and did you even need to sign up for anything?  If she applied through gov.uk then it has nothing to do with you, she would apply and you wouldn't do anything.  Other than wait for any refund due to arrive.

    Which 3rd party company did she use?  Have you checked the terms she agreed to?  Did you agree to any terms?

    Lastly, if you were aware that your spouse could do this on gov.uk then why didn't you get her to do that?
  • I did the application in my name as I'm the one transferring some of my wages to her or how ever it works. But the bottom line is I have my rebate but it feels like I've been done over by them. I fully expected to have to pay some sort of fee but it didn't explain during the application how much. I didn't do it through hrmc as I thought this would speed up the process I guess you live and learn. I'm dyslexic and have trouble with reading and writing. I would have expected them to lay it out when you start the application in bold so you don't miss it and understand what your singing up to. I'm just angry with myself with them. But it seems there is nothing I can do so will stop posting.

    You had better check that they are not entitled to anything from future claims.

    It depends on the benefits. Some are taxable, some aren't.

  • Hi 
    For the past few years I have been on just a works pension which was below my personal allowance and my wife was working so have transferred the marriage allowance to her.
    However she became ill last June and had to retire with a small works pension which is less in total than her personal allowance for the year. Also I have recently started to receive my state pension so now am receiving over my personal allowance and HMRC now say I will be underpaid this year and have coded out the underpayment in next years tax code.
    My question is can I get the marriage allowance back for this current 21/22 tax year as my wife won’t need it? I have cancelled the transfer for the coming year so it’s just the current year I have a problem with.
